Up close and personal with Howard Gardner

Up close and personal with Howard Gardner

By THEAN LEE CHENG

Harvard University professor of education Howard Gardner has been going around trying to help people to change their mind about how they see things, to look at issues from a different perspective.

"I want my children to understand the world, but not just because the world is fascinating and the human mind is curious. I want them to understand it so that they will be positioned to make it a better place. Knowledge is not the same as morality, but we need to understand if we are to avoid past mistakes and move in productive directions." – Prof of Education Howard Gardner, Harvard University.

With that famous quote, he has gone around trying to help people to change their mind about how they see things. To look at issues from a different perspective. Much of his interest in the workings of the mind and our human intelligences has to do with how he was brought up and his growing up years.

In 1938, Gardner's parents fled the holocaust with their first son, Eric who died in an accident shortly before he, Howard, was born,

As he grew up, neither of these events were discussed, but they were linked to his parents' refusal to allow their second son to play sports during school.

"They came with no money. My mother was pregnant with me when Eric died. If not for me, they would have killed themselves. So they invested a lot of hope on me. I was the first in the family to go into university. Expectations were great and that is fine because they did not pressure me.

"There were photographs of Eric but they said he was a boy in the neighbourhood. You may say, why would this matter to a 10 or 11-year-old. These two events affected me because they were kept secret. When one is traumatised, one of the ways is not to talk about it. But it is good to talk about it," says Gardner, a professor of education.

By the age of 13, young Gardner became an outstanding pianist and he even considered a career in music. He was also a Boy Scout and achieved the rank of Eagle Scout.

Gardner entered Harvard in 1961 with the intention of majoring in history. However, under psychoanalyst Erik Erikson, he changed his major to social relations, (a combination of psychology, sociology and anthropology) with interest in clinical psychology.

Gardner likes people. He likes working with people and what makes them the way they are and how he could change their mind. Which, essentially, was the purpose of his trip here.

Gardner was here to give a seminar on Changing Our Own and Other People's Mind, a seminar organised by Charles River Centre.

During that trip, Gardner was invited by Prime Minister Datuk Seri Najib Tun Razak and his family for lunch.

"It was a very interesting meeting. He wanted to know how to make Malaysians more forward and innovative in the way they think and do things. It was obvious he wanted to take the country forward. But how does one make the rest of the population have the same vision?

"He also asked about the use of IQ tests. I don't believe in IQ tests. They tend to favour those with linguistic skills and quite limiting. So that was the end of it," recalls Gardner.

And that is what leadership is all about, to get people to change their minds about how things should be done, or about any other matter. And nowhere is this more clearly seen than in the changing face of American politics.

Gardner says the election of Barack Obama illustrates how he has successfully changed the minds of the American public.

"I don't know him personally, but I know a lot about him," he says.

Gardner is involved with leaders of every calibre; artist Picasso, Winston Churchill, Margaret Thatcher, Franklin Roosevelt, dancer and choreographer Martha Graham, the list is endless.

"I am a teacher and part of my work is to present new ideas. And the kind of people I am dealing with are leaders who wants to know if I have something useful to contribute.

"Before my audience were educators but over the years, they have become more general. My last two books were printed by Harvard Business Press. Twenty years ago, I would never have through of that. But then, 30 years ago, I would not have thought about education."

Gardner says he does not go into a field because he thinks he can get an audience. I follow my interest and the audience come. Lately, my interest is good works and ethics. And then Lehman Brothers fell, and ethics became a subject every corporate person became interested in.

Gardner spoke about the different political leaders of the world. While they come from different lands and era, he is most enchanted with US President Barack Obama.

"He successfully created a personal bond between himself and the audience. The majority of that population resonate through his personality and were inclined to give him the benefit of the doubt. And when he asked them to do something, they listened sympathetically.

"He made them feel comfortable with him, the result is they resonate with him, and he with them. The amazing thing is, who is this man prior to his running for presidency?

"Nobody knew him, he is black, he has a name which nobody has heard of. He never really knew his father and he comes from a fragmented background in which his mother is white, twice married, and his father, black. As he constantly says, 'I don't look like you and I have an Islamic name.' He took that same idea and presented it in different ways.

"Any kind of mind-changing requires a story repeated time and time again. But if you use the same story, people get bored. That means you have to use different ways – writing, joking, talking, dramatising. The important thing is to embody and live it in different ways and that Obama did.

"He has big ears, he is not afraid to say he made mistakes, unlike George Bush, his predecessor who said he never made mistakes. So Obama made himself very human and that endeared him to the populace."

Gardner says Obama also used the events around him to change people's mind. "Things happen around us which we have no control, A(H1N1), natural disasters, the 9/11 incident. He used world events to bring about change. This applies not only to politics but the economic world as well. As a result of the fall of Lehman Brothers in September 2008, people began to be interested in ethics.

"It is natural to reward our friends and punish the enemy. But he did not do that. He worked with Hillary Clinton. He tried to understand the resistance and come to a compromise. So if you are trying to change somebody's mind, try to listen and understand the other person. That is an important way to change their mind. But your life must exemplify your story."

But there are instances when it is difficult to move the other person. This may be because they have been holding a certain point of view for a long time, they have an emotional connection about it and they have spoken publicly about it. So if you are a leader, you try to convince those who are sitting on the fence, rather than the extreme, he says.

The author of more than 20 books translated into 27 languages, Gardner went into psychology because of his interest in people. He is best known for his study on intelligences.

"A person may be intelligent in various aspects, but have poor people skills. Today, this is known as emotional intelligence. There are other forms of intelligences; linguistic, logical-mathematical, musical, bodily kinesthetic and so on. This means there is more than one way to teach, just as there are many ways to learn."

Because of his involvement with intelligence and the mind, he went into the field of education. Today, he has been with Harvard some 50 years.

"When I realised my colleagues have moved on to new places and doing new things, I did some surgery on my mind. I have stayed in the same place, with the same people and maybe that is a mistake. But then I told myself, I have moved on to new problems and new issues. My audience were at one time, educationists, then general, followed by business and corporate people. All of them are leaders in one way or another. And from here I move on to the my GoodWork Project which involves studying outstanding leaders in different professions."

Not that it has done everything that had to be done for those who have been deliberately marginalised by the society now for decades and ignored just to fill the coffers of rich industrialists of India. But kudos that it has reached here at least. I, personally, and our media house have both been severely critical of budgets year after year. After presenting alternative budgets for nine years on the trot, I finally see a government that has at least had the courage to come out in the open and present a budget which hardly has any sops worth talking about for the industry. Yes, the advantages that a few industrial houses will derive haven't gone unnoticed. But as I had written – with a lot of sarcasm and desperation – in our last issue: Let this budget be a 'Khao Aur Khilao' budget. And I won't look at vested interests which got served here and there. I will only look at the good that has happened. After more than four years post the launch of Business & Economy and our media house, here is a budget for which I have first class marks! It surely deserves a 6 to 6.5 out of ten. Just for its vision and boldness to announce only social measures one after the other at the cost of getting the middle getting upset. At the cost of stock markets registering their heaviest falls. At the cost of industrialists quietly having had to gulp down their disappointment and give TV bytes praising the budget – not because they realise the reasons why the budget is good, but because they knew their was nothing to logically criticize it on.

Now let's take a look at the details of the budget. Of all the rank bad budgets by the previous Congress terms – of course, with various kinds of external pressures – the only scheme that can be clearly considered their pet project that had Sonia, Manmohan and Rahul's full support was the NREGA (National Rural Employment Guarantee Act) scheme. And the best part of even this budget has been the huge 140 percent increase in NREGA allocations; and of course, the food guarantee scheme. The plan for providing direct subsidy to farmers is a very good move coupled up with the concept of biometric unique identification cards. It's a positive step towards removal of corruption.

This budget also sees a sense of gradual move towards strong reforms through the formation of the integrated energy act, shift in the fertilizer subsidy and efforts towards making domestic fuel prices move in sync with global prices. Further, another positive and super step towards removal of corruption in politics is the move to make all donations to political parties tax free. This would curtail donations in cash and make the system more transparent! For direct tax payers, the only real good news is that the incredibly silly and bureaucracy inducing FBT (Fringe Benefit Tax) has gone. Planman Media has been a

LAWYERSCHILE: GARY HAMEL Listen to Gary Hamel Explains What Fuels Long Term Growth

Listen to Gary Hamel Explains What Fuels Long Term Growth; Hear How to Negotiate When Yes is Not Enough with Danny Ertel & Mark Gordon

Gildan audio, a division of Gildan Media, today announces the release of three new audio book bestsellers.

"The Future of Management" written Gary Hamel with Bill Breen and read by Gary Hamel: What really fuels long-term business success?

Not operational excellence or new business models, but management innovation–new ways of mobilizing talent, allocating resources, and building strategies. Over the past century, breakthroughs in the "technology of management" have enabled a few companies–including General Electric, Procter and Gamble, Toyota, and Visa–to cross new performance thresholds and build long-term advantages. Yet most companies lack a disciplined process for radical management innovation.

Future of Management

Gary Hamel argues that organizations need bold management innovation now more than ever. The current management model–centered on control and efficiency–no longer suffices in a world where adaptability and creativity drive business success. In his most provocative book to date, Hamel takes aim at the legacy beliefs preventing twenty-first-century companies from surmounting new challenges. With incise analysis and vivid illustrations, he explains how to turn your company into a serial management innovator and reveals:

The make-or-break challenges that will determine competitive success in an age of head-snapping change

The toxic effects of our legacy management beliefs

The unconventional management practices generating breakthrough results in a handful of pioneering organizations

The new principles every company must weave into its management DNA

The Web's potential to obliterate smokestack management practices

The actions your company can take now to build its own management advantage

Get ready to throw off the shackles of yesterday's management dogma. Tomorrow's winners will be those companies that start inventing the future of management today.

"With great style and flair, this audio book will open your eyes, rewire your thinking, and reset your aspirations for what you and your organization can achieve. Business's most provocative thinker has written his most thought-provoking book yet," says Eric Beinhocker, author of "The Origin of Wealth". ISBN# 1-59659-161-7, 7 CDs- Approx 8 Hours; $29.98.

"Becoming a Resonant Leader" by Annie McKee, Richard E. Boyatzis and Fran Johnston: A powerful case has been made for emotional intelligence and its role in leadership. As Annie McKee and Richard Boyatzis showed in their bestselling books, "Primal Leadership" and "Resonant Leadership", the best leaders use their emotional intelligence to create resonance with others.

Resonant leaders are attuned to the needs and dreams of the people they lead. They create conditions in which people can excel. They listen to life's wake-up calls and enhance their capacity for excellence.

In "Becoming a Resonant Leader" the authors provide a clear process and a wealth of exercises to help you develop your emotional intelligence and sustain resonance in your relationships. Reflecting twenty years of research and work with executives, the exercises in this practical audio resource help you:

Develop your emotional intelligence

Create a vision of your ideal self and desired future

Articulate your strengths and values

Craft a plan for intentional change

Build resonance with your team, organization and community

"I'm often asked how a person can enhance the emotional intelligence-based competencies that distinguish star performers and leaders. Now there's an answer: 'Becoming a Resonant Leader' lays out the practical, tested steps so anyone can benefit," says Daniel Goleman, author of Emotional Intelligence. ISBN# 1-59659-165-x 5 CDs-Approx 5 1/2 Hours; $29.98.

"The Point of the Deal: How to Negotiate When Yes is Not Enough" by Danny Ertel and Mark Gordon: Why do so many deals that look good on paper end up in tatters? Deal makers often treat the handshake or signed contract–getting to "yes"–as the final destination in their bargaining journey rather than the start of a cooperative venture.

Even worse, most companies reward negotiators on the basis of the number and size of the deals they're signing, giving them no incentive to negotiate deals that actually work.

In The Point of the Deal, Danny Ertel and Mark Gordon explain how to transition from a deal-maker mentality (focusing on making the agreement) to an implementation mind-set (ensuring the deal generates value for your company after the ink on the contract has dried. The authors show you to:

Treat the deal as a means, not an end, by asking what you need from your counterpart over and above a "yes."

Consult stakeholders, determining whom you'll need to get to "yes" and beyond

Set precedents that will help guide joint behavior after you've signed the deal

Air your concerns–in ways that still get you to "yes" and beyond

Help your counterparts avoid over committing–maximizing the likelihood they'll be able to deliver on their part of the bargain

Run past the finish line–by articulating how you'll get from "yes" to your final destination

With a wealth of examples from multiple industries, countries, and functions, the authors illustrate how their approach to instilling an implementation mind-set works in all kinds of familiar contexts for business deals–including mergers and acquisitions, joint ventures, alliances, outsourcing arrangements, and customer and supplier relationships.

"The Point of the Deal" not only offers crucial advice for individual negotiators and teams, it also enables managers to treat negotiation as a critical business process that drives real value for their organizations.

"In this important and refreshing audio book, Ertel and Gordon remind us all: in every negotiation, know your purpose and don't forget it," says Roger Fisher, Coauthor of "Getting to Yes". ISBN# 1-59659-168-4, 7 CDs-Approx 8 Hours; $29.98.

And although optimism is still the prevailing mood, many business leaders perceive the need for new management strategies to deal with the challenges and opportunities of a changing business landscape, as 33% of the surveyed said management and leadership failure is the main reason behind the current financial turmoil.

These are some of the highlights of the Doing Business In the Gulf Survey conducted by the Leaders team among more than 600 business leaders and top executives in the region ahead of the forthcoming Leaders in Dubai Business Forum.

'Management, like the combustion engine, is a mature technology that must now be reinvented for a new age. Managers today face a new set of problems, products of a volatile and unforgiving environment,'

said Gary Hamel, currently the world's leading business strategist and management guru.

In addition to Hamel, other notable personalities speaking at the Leaders in Dubai Business Forum, appropriately titled New Beginnings, on October 26 -28, 2009 at the Dubai International Convention and Exhibition Centre, include Archbishop Desmond Tutu and 2007 Nobel Peace Prize winner, The Honourable Al Gore, among others.

'The business world has changed,' said Lucy Mountain, Project Director, Leaders in Dubai Business Forum. 'And along with that change comes an urgent call for businesses to adapt yet again to face mounting challenges and take advantage of still emerging opportunities.'

The event is sponsored by Philips, The Monarch Hotel, Saxo Bank, Dubai Islamic Bank, Canon, Al Arabiya and BBC World.

The nation's largest insurers, hospitals and medical groups have hired more than 350 former government staff members and retired members of Congress in hopes of influencing their old bosses and colleagues, according to an analysis of lobbying disclosures and other records.

The tactic is so widespread that three of every four major health-care firms have at least one former insider on their lobbying payrolls, according to The Washington Post's analysis.

Nearly half of the insiders previously worked for the key committees and lawmakers, including  Sens. Max Baucus (D-Mont.) and  Charles E. Grassley (R-Iowa), debating whether to adopt a public insurance option opposed by major industry groups. At least 10 others have been members of Congress, such as former House majority leaders Richard K. Armey (R-Tex.) and Richard A. Gephardt (D-Mo.), both of whom represent a New Jersey pharmaceutical firm.

The hirings are part of a record-breaking influence campaign by the health-care industry, which is spending more than $1.4 million a day on lobbying in the current fight, according to disclosure records. And even in a city where lobbying is a part of life, the scale of the effort has drawn attention. For example, the Pharmaceutical Research and Manufacturers of America (PhRMA) doubled its spending to nearly $7 million in the first quarter of 2009, followed by Pfizer, with more than $6 million.

The push has reunited many who worked together in government on health-care reform, but are now employed as advocates for pharmaceutical and insurance companies.

A June 10 meeting between aides to Baucus, chairman of the Senate Finance Committee, and health-care lobbyists included two former Baucus chiefs of staff: David Castagnetti, whose clients include PhRMA and America's Health Insurance Plans, and Jeffrey A. Forbes, who represents PhRMA, Amgen, Genentech, Merck and others. Castagnetti did not return a telephone call; Forbes declined to comment.

Also inside the closed committee hearing room that day was Richard Tarplin, a veteran of both the Department of Health and Human Services and the Senate, where he worked for  Christopher J. Dodd (D-Conn.), one of the leaders in fashioning reform legislation this year. Tarplin now represents the American Medical Association as head of his own lobbying firm, Tarplin Strategies.

"For people like me who are on the outside and used to be on the inside, this is great, because there is a level of trust in these relationships, and I know the policy rationale that is required," Tarplin said in explaining the benefits of having government experience.

But public interest groups and reform advocates complain that the concentration of former government aides on K Street has distorted the health-care debate, and that it further illustrates the problem posed by the "revolving door" between government and private firms.

"The revolving door offers a short cut to a member of Congress to the highest bidder," said Sheila Krumholz, executive director of the Center for Responsive Politics, which compiled some of the data used in The Post's analysis. "It's a small cost of doing business relative to the profits they can garner."

Aides to Baucus and other lawmakers bristle at any suggestion of special treatment for former staff members. Baucus spokesman Scott Mulhauser said the senator "remains committed to working with a variety of stakeholders" as the Finance Committee attempts to come up with a bill this summer.

"The senator and his staff meet daily with individuals, nonprofits and interests from across the health-care spectrum, and are proud that all interests are treated equally and that no one receives special treatment of any kind," Mulhauser said. "As a result, the Finance Committee has been praised by members of Congress and the media for its uniquely inclusive and transparent health-care reform process."

'Ghana: Bloggers Discuss Business Process Outsourcing'

'Ghana: Bloggers Discuss Business Process Outsourcing'
by Gayle Pescud

Few know that A.T.Kearney rated Ghana as sub-Saharan Africa's number one Business Process Outsourcing (BPO) destination in 2005 and, as of June 2009, the nation's achievements in this field look set to continue. Several bloggers reported on an agreement signed in early June between two leading ICT organisations that will provide unprecedented opportunities for ICT students, create thousands of jobs, and underpin the growth of this nascent industry.

Mr Eddie Turkson reported on the details of the agreement:

"THE Ghana Telecom University College (GTUC) has signed a partnership agreement with Rising Data Solutions Limited (RDS), a business process outsourcing (BPO) company, to train people and create jobs in the Information and Communications Technology (ICT) industry.

Under the agreement, RDS will provide a curriculum and logistics in the field and train teachers to teach the course at the college, while GTUC would house the classrooms, hardware and teaching personnel for the implementation of the course.

The college will also absorb the class into its official curriculum where students who earn qualifying marks in the course will gain employment with RDS.
The President of GTUC, Dr Osei K. Darkwa, said the government had identified Information Technology Enabled Service (ITES) and the BPO industry as one of the key industries for the creation of jobs and the provision of marketable skills for the youth for the country to position itself as a destination of choice for outsourcing."

Ghana Voices defined the BPO industry as:

An information technology enabled service industry in which clients from other parts of the world subcontract services of which they have low competitive advantage over to local firms who have high competitive advantage in that area.

Ghana Voices also discussed the sector's potential to benefit the country, stating that:

It is estimated that the sector could provide over 37,000 jobs for the youth by 2011 in Ghana, with an added value to the country's economy of over 750 million dollars.

Bpoevents reported Dr Darkwa's hopes for students' skills development:

Dr. Darkwa expressed the hope that, the collaboration with RDS would equip the students in the areas like communication skills, computer skills, telemarketing, listening skills, accent neutralisation and keyboard skills which are required to succeed in the industry. Supporting this hope, Mr A. J. Whitman, RDS's Public Relations Manager, said that this partnership was part of RDS's campaign to bring more jobs to Ghana.

Daikieusown quoted Mr Whitman as saying:

We are proud of this partnership with GTUC, in large part because both parties recognize that the private sector cannot grow without the education sector, and vice versa. While still fledging in Ghana, RDS is banking on their ability to drive the sector by strategic partnerships, allowing skills development based on knowledge sharing that benefits all stakeholders, most importantly students.

The BPO industry has been a significant economic driver of countries such as India, Malaysia, and the Philippines, which had been responsible for the creation of tens of thousands of jobs.

Even Vodaphone, noted Eddie Turkson, commented on the agreement:

The Head of Corporate Communication, Vodaphone, Mr Albert Don-Chebe, gave assurance that Vodaphone was strongly behind the deal and commended RDS for having the courage to invest in Ghana, despite the challenges.

During the ceremony, Dr Darkwa mentioned that the challenges facing the industry were the "shortage of manpower which was restricting its growth", as reported by Ghana Voices, and that:

It was to reverse this trend that the GTUC signed the MOU with the RDS to develop a talent pipeline in the short and long term, which would ensure continuous supply of trained manpower to feed the industry.
His colleague, Dr. Robert Baffour, The Vice President of GTUC, further stressed that GTUC would continue to develop all necessary platforms and build the requisite foundation to place Ghana on the technology map

 Daikieusown quoted Dr Baffour:

GTUC has been the leader in ICT activities in the country and would continue to lead and chart the way forward for our country.""

on the evening of the ceremony in Accra.

Michael Jackson's Will Released, but Who Wrote It?

Michael Jackson's Will Released, but Who Wrote It?

Last week, I wrote about some of the potential medical malpractice issues that Michael Jackson's death might raise. This week, the legal issues associated with Jackson's recently released will are driving the discussion.

The New York Times summarizes the provisions of Jackson's five-page will, dated July 7, 2002. The document gives the estate to the Michael Jackson Family Trust Fund and names his mother, Katherine Jackson, as legal guardian of his children, with Diana Ross serving as backup if Jackson's mother predeceased him.

Though Jackson provided for his children, he also stated that he “intentionally omitted to provide for” Deborah Jean Rowe Jackson, the mother of his two oldest children. The will also granted John Branca, an entertainment lawyer, and John McClain, a music executive and longtime friend, full power over Jackson's financial matters.

So what are some of the potential will disputes so far? For starters... [MORE]

LAWYERSCHILE: Law Firm Sued for Using Ill-Gotten Evidence From Spyware

Law Firm Sued for Using Ill-Gotten Evidence From Spyware

Let's say that you're a divorce attorney and your client brings you damning e-mails that will help her case. Before you decide to use those e-mails at trial, you'd better make sure that they weren't procured through the use of illegal spyware. Otherwise, as Sharon Nelson of Ride the Lightning cautions, you might find yourself the subject of a $2 million lawsuit like the lawyers at Chattanooga, Tenn., firm Berke, Berke & Berke (a firm name that has nothing to do with this guy).

According to Chattanoogan.com, Farrell Hayes is suing the Berke firm (and the individual name partners) for $2 million in a Tennessee circuit court for alleged use of e-mail spyware. Hayes claims that his soon-to-be ex-wife installed eBlaster software on his computer in order to intercept his communications. The software directed Mr. Hayes' e-mail to his former sister-in-law, and she passed them on to his wife. Hayes claims that the interception of the e-mails violated... [MORE]

LAWYERSCHILE: Applicant Denied Bar Admission for Too Much Debt

Applicant Denied Bar Admission for Too Much Debt

Seems that University of California Hastings College of Law graduate Robert Bowman is in a bit of a catch-22, courtesy of the New York State bar. As The New York Times reports, Bowman owes roughly $400,000 in student loans. But Bowman doesn't stand a chance of ever repaying those loans now that he's been denied admission to the New York bar, because five appellate judges viewed Bowman's hefty debt and inability to repay it as evidence of a "lack of general character and fitness requisite for an attorney."

To be fair, the judges were more concerned with the fact that Bowman hadn't made any payments on his debt since 2000, when he graduated law school, rather than the size of the amount owed. But Bowman has had a difficult time along the way. He paid for college (he needed 10 years to graduate, for medical reasons), law school and a masters of law program in London through loans -- 32 in all. He then took the bar four times before he managed to pass. In the meantime, he experienced medical problems and duly sought deferrals from his lenders, who either failed to record his requests or improperly denied them.

In his bar application, Bowman stated that he intended to... [MORE]

LAW JOURNAL

TODAY'S NEWS

For jurors in Michigan, no tweeting (or texting, or Googling) allowed

The Michigan Supreme Court has laid the hammer down on gadget-happy jurors in banning all electronic communications by jurors during trial, including tweets on Twitter, text messages and Google searches. The ruling, which takes effect Sept. 1, will require Michigan judges for the first time to instruct jurors not to use any handheld device, such as iPhones or Blackberrys, while in the jury box or during deliberations.

Law school pays students to stay away

The unstable economy created a tricky situation for law school admissions offices this year. The University of Miami School of Law underestimated the percentage of accepted students who enroll — and is offering incentives for students to sit out a year. Those who opt to delay until the fall of 2010 will receive a $5,000 scholarship when they complete 120 hours of public service and will have a better chance at receiving a $75,000 scholarship, among other incentives.

9th Circuit: Web ad blockers have broad shield from suits

Software companies that help computer users halt Internet ads and viruses have a broad immunity from lawsuits brought by companies whose Web pages are blocked, the 9th Circuit ruled last week in Zango v. Kaspersky Lab. But the federal appellate court sounded a cautionary note about the breadth of immunity the software companies enjoy.

Firm accused of duping malpractice claimants

Former clients of a Cleveland-based law firm have convinced an Ohio appeals court to revive their claim that the 45-attorney shop duped them into a low-ball settlement in a legal malpractice case. Reversing a lower court, the three-judge panel threw out summary judgment in favor of Javitch, Block & Rathbone, a collections and bankruptcy firm with four offices in Ohio and Indiana.

THIS WEEK'S ISSUE

THE PRACTICE

In opening a case, grab the jurors' attention

A strong, accurate and interesting opening that clearly states the theme of your case is a good way to grab the attention of the audience, whether composed of laypeople or judges. With a bit of concentrated effort and imagination, the creative advocate can usually find an appealing — even universal — theme even in the most mundane of cases.
