Dear rodrigo:

June on "Adam Smith, Esq." seemed to feature—unintentionally, I might add—an emphasis on both strategy and leadership.  

Actually, strike the "unintentional" part.  My focus is strategy and leadership, along with all of the moving parts they entail:  Finance, IT, marketing, cultural considerations, partnership structures, compensation, globalization, and M&A.  So perhaps it was not accidental after all.

Continuing with my commitment to bring subscribers to the "Adam Smith, Esq." newsletter original content which has not been and will not be published on the site, you will find at the end of this edition a link to a piece recounting a conversation I had in London with Tony Williams, former global managing partner of Clifford Chance, subsequently global managing partner of Andersen Legal (when it was, briefly, the ninth largest law firm in the world by revenue), and now head of his own City-based consultancy, Jomati.

As a result of that conversation, I would like to think Tony is a friend, and he is nothing if not a provocative and sometimes contrarian thinker about where our beloved industry is heading.

So, without further preliminaries, to this past month's "greatest hits:"

  • In "Strategy Formulation in an Unknowable Universe," I discuss how to liberate your strategic planning process from the annual creation of turgid 3-ring binders symbolically stamped "file and forget" to a living, breathing, invigorating reality at your firm.  Hint:  Try lots of little bets, not a few big ones.
  • In "Great Managers Fail," I recur to the wisdom of the medieval apprenticeship system, and what lessons it might hold for our current career-track-challenged environment.
  • "Making Decisions like an Associate...?" cites new Harvard Business School findings on how a leader's decision-making style needs to evolve over the course of one's career—in fact, how it must "do a complete flip."
  • I borrow from the wise observations of my friend Rich Gary (former chair, Thelen-Reid) in "A Pop Quiz for your CMO," where the moral is that managing partners get the C-level executives they deserve.
  • The all-important issue of associate dissatisfaction and even alienation from the traditional Cravath Model career track gets double billing in "How Many Hours Would Elihu Root Bill?and in "'Is This Model Sustainable...'", where David Childs, newly elected managing partner of Clifford Chance, poses precisely that question.  The inimitable David Maister also seems to having some of the same thoughts, and he alludes to me and takes them for his own brilliant wild ride.

Finally, to the synopsis of my conversation with Tony Williams.  Please click here to read Tony's wonderfully humane, but challenging, thoughts on the sea changes affecting our profession, the US/UK divide (and whether any US firm is really making money in London), and the truly differentiating value of leadership at the start of the 21st Century.  Lest you be tempted to skip over Tony's thoughts, let me tempt you with this brief excerpt:

[Posible SPAM] big decision today

Hamdan: The Court's Big Decision Today
Earlier today, the Supreme Court announced its long-awaited decision in U.S. v. Hamdan, which addressed the legality of the Bush admistration's policy of ordering military war crimes trials for Guantanamo Bay detainees. As summarized by the SCOTUS Blog, in a 5-3 the Court held that President Bush did not have authority to set up the tribunals at Guantanamo Bay, Cuba, and found the commissions illegal under both military justice law and the Geneva conventions. But several of the justices suggested that Bush could return to Congress to seek the authorization that the Court found lacking. Other notable tidbits from the case:  Justice Thomas, who dissented, read his opinion from the bench, the first time he's done so in 15 years on the court.  And Justice Roberts recused himself; it was his D.C. Circuit ruling in Hamdan that the Supreme Court reversed.

Reviews and summaries of the decision are coming in all over the online media and blogosphere. Summaries of the ruling can be found here (Gina Holland, Associated Press) and here (John O'Neil and Scott Shane at New York Times). Blogger Orin Kerr remarks preliminarily that Justice Kennedy's concurrence reflects a belief that "Congress'  views are supreme," and Peter Lattman at WSJ Law Blog profiles Neal Kaytal, the Georgetown Law professor whose argument for Hamdan was his maiden voyage at the Supreme Court. SCOTUS blog features guest commentary from Richard Samp of the Washington Legal Foundation, who begins  his post with his opinion that "I'd be surprised if any of the holdings in today's Hamdan decision end up having large practical significance." And also at SCOTUS is this post from Lyle Deniston, who writes that Hamdan is notable for what it did not decide, including the question of whether or not there actually exists a "presidential 'inherent power' of the kind that President Bush claims under his commander-in-chief powers."

Competitors Sue Craigslist for Discrimination
Craigslist, an online classified ad Web site that doesn't charge to place or post ads, defied conventional wisdom that advertising needs to cost money. But now, per this here post by Craig Williams of  May It Please the Court, looks like Craigslist is breaking new ground for another reason: it's been sued for violations of housing discrimination laws, not by victims of discrimination or special-interest groups but by its "for fee" competitors:  newspapers. 

Williams' post explains that newspapers are required to comply with U.S. Department of Housing and Urban Development requirements on nondiscriminatory housing ads, whereas Craigslist does not. Forcing Craigslist to monitor ads to ensure compliance with housing law and other nondiscrimination laws would increase costs for Craigslist and, perhaps, force it to charge for postig ads. Williams points out that Craigslist should not be treated the same as newspapers because "ads on CraigsList are free and posted by individuals. Ads in newspapers cost, and they are posted by newspaper staff." But ultimately, Judge Amy St. Eve in Chicago will decide if that distinction will save Craigslist. In addition, Craigslist has friends in high places, like Google, AOL and eBay, which filed an amicus curiae brief, arguing that Craigslist is protected from liability for HUD violations in the same way the phone companies and Internet providers are protected from liability for violations of the law occurring over their wires. 

Williams comments:

It didn't help that CraigsList has taken a lot of housing ads away from newspapers, which may be the real genesis for the lawsuit. Especially when the ads are free.  That's a lot of lost revenue, and the HUD claim is a creative attempt to stopgap that lost revenue stream.

I'd be interested in knowing, as a practical matter, how many of Craigslist's ads actually violate housing discrimination laws. Do newspapers have standing to bring these claims at all? They may argue they're disadvantaged by compliance with discrimination laws, but they're not the parties that the laws were intended to protect. Seems that the court should at least wait until a truly injured party complains to rule on these issues.

The Alito Effect
The Supreme Court issued three opinions today, upholding a Republican-engineered Congressional redistricting plan in Texas (League of United Latin American Citizens v. Perry), upholding a Pennsylvania ban on newspapers and magazines for prison inmates (Beard v. Banks) and  ruling that states may bar foreign nationals from raising treaty rights not raised at trial (Sanchez-Llamas v. Oregon). Lyle Denniston has more at SCOTUSblog.

The Pennsylvania case is one in which Justice Alito, as a member of the 3rd U.S. Circuit Court of Appeals, was the lone dissenter voting to uphold the ban. He did not participate in today's ruling. Yesterday, Tom Goldstein posted his thoughts on the effect of Alito on the Court, noting:

"This timing of Justice O'Connor's retirement provides an unusual opportunity to isolate the effect of the appointment of Justice Alito on the Court's jurisprudence."

For the three cases reargued after O'Connor's departure, Goldstein offers "a very educated guess" on whether Alito's appointment changed their outcomes. In two of the three, he says, the answer is yes.

In Garcetti v. Ceballos, Goldstein notes that Justice Souter ended up writing no majority opinions from the Court's October sitting, while Justice Kennedy ended up writing two, of which Garcetti was one.

"Because there were only 8 cases argued in October, no Justice should have ended up writing the opinions for the Court in two cases. ... So it is fair to conclude that Justice Souter had the majority before Justice O'Connor's retirement, then lost it when Justice Alito joined the Court."

Hudson v. Michigan suggests a similar scenario, Goldstein writes. While the eventual opinion was authored by Justice Scalia and the principal dissent was by Justice Breyer, the fact that Scalia ended up with two opinions from the January sitting and Breyer had none means "it is fair to conclude that Justice Breyer had the majority before Justice O'Connor's retirement, then lost it when Justice Alito joined the Court."

In the third reargument, Kansas v. Marsh, O'Connor's retirement appears not to have made a difference, Goldstein says.

"Justice Thomas ended up with no opinion from the December sitting, indicating that Marsh was the opinion he would have authored for that sitting had it not been reargued. Justice Souter wrote a majority opinion for that sitting, indicating he did not lose a majority from that sitting."

Rebranding the Plaintiffs' Bar
From the Wall Street Journal's Law Blog comes a pointer to the WSJ's Washington Wire reporting that a name change may be in the offing for the Association of Trial Lawyers of America. Washington Wire's John Harwood reports that ATLA plans to take a vote at its annual meeting in July "on a new moniker that ATLA leaders hope will better communicate trial lawyers' mission in the face of criticism by business interests and Republican officials." ATLA's communications director Chris Mather told Harwood that the new name is undecided, but is likely to include the word "justice."

Meanwhile, back at the WSJ's Law Blog, Peter Lattman is kicking off a contest inviting suggestions for ATLA's new name. He doesn't promise a prize, but given the WSJ's big-business bent, I suspect the winning entry is unlikely to pass muster with the plaintiffs lawyers of ATLA.

My suggestion: Justice League of America. Or is that already taken?

Task Codes for E-Mail Overload
E-mail can overwhelm a lawyer. For those of you with overstuffed inboxes, TechnoLawyer Blog highlights one lawyer's "clever method for quickly delegating items in his e-mail inbox." The reference is to a recent article published in ALI-ABA's The Practical Lawyer, Delegating the Deluge: Action Codes for Forwarding Email." The author, Joshua Stein, a real estate and finance partner at Latham & Watkins in New York, describes the system he devised of "e-mail action codes" to use when forwarding e-mails to his assistant.

At some point after e-mail began to overwhelm him, Stein writes, he realized he could delegate to his assistant messages that required straightforward and definable tasks. This created its own problem, because each task needed his explanation, and providing it sometimes took longer than the task itself. So Stein came up with his series of task codes:

"Now, whenever I receive an email message that requires one of these actions, I click on 'forward,' move the cursor to the end of the subject matter line of the email message, type the abbreviated action code right there, and send the message to my assistant for further processing. My assistant then handles that particular piece of my email deluge, so I can spend more time doing legal work and less time doing data entry, file manipulation, and processing."

Stein's article sets out his series of codes and invites others to use them. Of course, there is one drawback to Stein's system -- it requires that you have an assistant.

California's Traps for Unwary Employers
California's employment laws bear a deceptive resemblance to their federal counterparts. But their seeming similarity can lull unsuspecting, out-of-state employers into a false sense of comfort. So say Anthony J. Zaller and Brian F. Van Vleck of Carlton, DiSante & Freudenberger in a guest post today at InhouseBlog. The two provide their top 10 list of the costliest problems that out-of-state employers need to know about in California.

Topping the list: meal and rest period penalties. They explain:

"This is the current favorite claim of plaintiff's class action attorneys in California. A 2001 statute imposes substantial penalties on employers who do not comply with very technical regulations concerning the timing and duration of employee lunch and rest breaks. ... The aggregate liability that can result over time was aptly demonstrated by a 2005 jury verdict in a meal and rest break class action against Wal-Mart that awarded over $192 million in penalties and punitive damages."

And U.K. Law Firm of the Year Is ...
(Drum roll please.) Clifford Chance. It was honored last night as U.K. law firm of the year during "a sparkling event" hosted by the U.K. magazine The Lawyer. The magazine reports:

"Freshfields Bruckhaus Deringer was the other big winner of the night, picking up prizes for Banking/Restructuring Team of the Year, M&A Team of the Year and Pro Bono Team of the Year."

The Lawyer named DLA Piper Rudnick Gray Cary as Global Law Firm of the Year and Simpson Thacher & Bartlett as U.S. Firm of the Year.

DECLARACION DE DERECHOS FUNDAMENTALES EN LA RED.

Declaración de Derechos Fundamentales, en Libertad Digital

No podemos que estar de acuerdo con Enrique Dans:

Mi columna de esta semana en Libertad Digital se titula "Declaración de Derechos Fundamentales", y postula la necesidad de una declaración de ese tipo, a modo de Bill of Rights de la Constitución Americana o de Declaración de los Derechos Humanos, que proteja a los ciudadanos de la red de los excesos de legisladores trasnochados, lobbies empresariales de oscuros y turbios intereses, y pretensiones de limitar cosas tan básicas y tan importantes como la neutralidad de la red.

La red es joven, y son muchos los intereses en pervertir o dominar su funcionamiento para situarse así en una situación de ventaja. El simple hecho de que la discusión sobre la neutralidad de la red, que postula la creación de una Internet completamente diferente a la actual, en la que "unos bits serían más iguales que otros" y podrían circular a más velocidad, llegue a ser discutida en el Parlamento de los Estados unidos es una ofensa total al sentido común, una verdadera barbaridad conceptual. Pretender que las compañías de telecomunicaciones pasen de ser un mero canal proveedor de infraestructura a ser capaces de examinar los contenidos que circulan y, en función de los acuerdos e intereses que tenga, decidan acerca de la velocidad con la que circulan es una idea contra la que es preciso que los internautas tengamos algún tipo de protección, una declaración de derechos que pueda ser esgrimida en esos casos, y que convierta al país que no la cumpla en un apestado, en un sospechoso, en alguien que no respeta lo más fundamental. La red va necesitando una declaración así.

VERY IMPORTANT

There are many ways you can restrict your creative energy: For instance:

  • You feed your body with unhealthy junk food
  • Accumulated toxins block your body's physical energy
  • You don't feed your body with enough needed nutrients like vitamins and minerals
  • You don't exercise enough
  • You have some hormone imbalance due to age or other reasons
  • Your immune system needs better care
  • Your life energy is electrically, magnetically, chemically or otherwise perturbed
  • You use poor stress management techniques
  • Your energy is blocked by automatic reactions to old painful emotions
  • Your Belief System brings conflicting and unwanted results
  • Your values need to be clarified
  • You still need fixing some addiction problem
  • Your energy is not focused on worthy rewarding goals
  • Your Self Talk is usually negative
  • Your Self Image needs minor or even major adjustments
  • You mismanage close relationships
  • You stopped learning and discovering the world to stay in your comfort zone
  • You do not make full use of your unique gifts and talents to create and give
  • Your spiritual life is inexistent or weak
  • You have no plans for your health, love life, career, wealth or any things you really want

Lawyer or a no -too lawyer?

Are You a Go-To Lawyer or a No-Too Lawyer?
Lawyers can be placed into two different categories:  "go to" lawyers, the type of proactive, can-do lawyer who everyone  wants to work with and "no too" lawyers (as in "I'll say no to that too"), who always tell clients what they can't do.   In this post, Larry Bodine describes the characteristics of each.  According to Bodine, go-to lawyers are up-to-date on the law, grasp their clients' strategic issues and "put some skin in the game," by sharing risks with clients.  By contrast, no-too lawyers reflexively tell clients no, don't bother to learn about the client and its business environment, don't return phone calls or keep current on issues.

Bodine wants to know: "Which lawyer are you?"

'BE IRREPRESSIBLE! A CAMPAIGN FOR GLOBAL INTERNET FREEDOM'

As more and more nations carve up the so-called global, borderless internet into separate spheres of control through filtering and censorship, often using technology supplied by large IT companies, Amnesty International has launched a new campaign - irrepressible.info to raise awareness of and protest against the infringements on the basic human right of freedom of speech.

Chat rooms monitored. Blogs deleted. Websites blocked. Search engines restricted. People imprisoned for simply posting and sharing information.

The Internet is a new frontier in the struggle for human rights. Governments – with the help of some of the biggest IT companies in the world – are cracking down on freedom of expression.

There are specific examples of some of the countries and companies in the spotlight:

The web is a great tool for sharing ideas and freedom of expression. However, efforts to try and control the Internet are growing. Internet repression is reported in countries like China, Vietnam, Tunisia, Iran, Saudi Arabia and Syria. People are persecuted and imprisoned simply for criticising their government, calling for democracy and greater press freedom or exposing human rights abuses, online.

But Internet repression is not just about governments. IT companies have helped build the systems that enable surveillance and censorship to take place. Yahoo! have supplied email users’ private data to the Chinese authorities, helping to facilitate cases of wrongful imprisonment. Microsoft and Google have both complied with government demands to actively censor Chinese users of their services.

The campaign has three main points of action - firstly urging people to sign a pledge on internet freedom, secondly encouraging individuals to undermine censorship by publishing "irrepressible" fragments on censored material on personal sites and thirdly to take action on behalf of imprisoned Chinese journalist Shi Tao

The second option involves putting a piece of javascript on your site which will generate a box containing random pieces of censored information. If the reader clicks on the box they are taken to the campaign page where, not entirely obviously, there is more information about where the random piece of information originated and a url to the censored website.

The fragments are generated from a database of censored material which is being compiled by the OpenNet Initiative which also has an interactive map with a geographical representation of their detailed research into national efforts to filter the internet.

At least 200 people signed the internet freedom pledge in the time it took me to write this post, according to the counter on the irrepressible.info main page, bringing the total to nearly 13,000 signatures. Let's make some noise, and make a difference.

'SPECIAL INDONESIA EARTHQUAKE BLOG'

The helps and donations which come from around the globe on the 6.2 richter scale earthquake in Yogyakarta, Central Java, Indonesia have been heartening.  Indonesians  outside Yogyakarta also watch the post-earthquake news very closely some of them a bit confused as to how to make donation and to which institution they can channel their donation through.

JURISPRUDENCIA DE CORTE SUPREMA, CORTES DE APELACIONES Y ALGUNAS NOTICIAS RELEVANTES DE LA SEMANA.

Civil

Recurso de Casación en el Fondo rechazado. Demanda civil de indemnización de perjuicios por responsabilidad extracontractual. Infracción a los artículos 1, 5 y 19 Nº1 de la Constitución Política de la República, que reconocen la dignidad de la persona humana, y aseguran su integridad psíquica y física; del artículo 38 inciso 2º de la Carta Fundamental que consagra la responsabilidad extracontractual de la Administración del Estado.

Recurso de Apelación rechazado. Juicio Ejecutivo. Avenimiento de autos es una transacción que ha puesto término al juicio, y que en caso de incumplimiento sólo da derecho para iniciar un nuevo juicio. Artículo 775 del Código de Procedimiento Civil.

Recurso de Apelación acogido. Juicio Ejecutivo. Tercería de Posesión. presunción del artículo 700 del Código Civil. Demandadas no rindieron prueba alguna para desvirtuar las pretensiones del actor, ya que la causa se siguió en su rebeldía. Alzamiento del embargo impugnado.

Laboral

Recurso de Casación en el Fondo inadmisible. Juicio Laboral. Vulneración de los artículos 174 del Código del Trabajo en relación al 10 y 1.687 del Código Civil. Se declaró nulo el despido de la actora porque este gozaba de fuero laboral y el demandado no solicitó la autorización judicial correspondiente.

Recurso de casación en el Fondo rechazado. Juicio Laboral. Quebrantamiento de los artículos 1.545, 1.560, 1.562 y 1.566 del Código Civil. El fallo recurrido al decidir que el trabajo se encontraba ligado con una orden de servicio y no con el contrato que la demandante celebró con Codelco, habría vulnerado el espíritu y el texto de la cláusula contenida en el contrato de trabajo vigente.

Recurso de Casación en el fondo rechazado. Juicio Laboral. Infracción de los artículos 426 y 442 del Código del Trabajo, 19 Nº 3 de la Constitución Política de la República y 19 a 24 del Código Civil. Violación a las normas del debido proceso al dejarlo en la indefensión por declararse extemporánea su prueba, no obstante haberla acompañado dentro del plazo legal.

Recurso de Casación en el Fondo rechazado. Juicio Laboral. Quebrantamiento de los artículos 19 Nº 15 de la Constitución Política de la República y 2.053, 2.058 y 545 del Código Civil. Sociedad demandada es una sociedad de hecho que no puede ser legitimada pasiva del actual pleito, no es capaz de ejercer derechos y de contraer obligaciones civiles, correspondiendo que sus asociados fueran condenados solidariamente al pago a sus asociados, los sentenciadores han hecho aplicación falsa de las normas que por medio de este recurso se dan por infringidas.

Recurso de Casación en el Fondo rechazado. Juicio Laboral. Infracción a los artículos 2 inciso primero de la Ley Nº 3.918 y 1.560, 2.465 y 2.469 del Código Civil. Socios de una sociedad de responsabilidad limitada responden por el monto de sus aportes o a lo más, la suma que se indique en el acta constitutiva. En el fallo recurrido se expresa que no se puede perseguir el patrimonio personal de los socios de una sociedad de responsabilidad limitada, naturaleza que posee la sociedad demandada para solucionar las obligaciones que dicha sociedad contrajo con terceros, en este caso, los trabajadores.

Recurso de Casación en la Forma inadmisible. Juicio Laboral. Causal 5del artículo 768 del Código de Procedimiento Civil, en relación con el artículo 170 del mismo texto legal, Auto Acordado sobre la Forma de las Sentencias, numerales 6 y 7, fundado en que el fallo de primer grado habría omitido analizar los testigos presentados por su parte para acreditar que el empleador de los actores era el demandado.

Comercial

Recurso de casación en el Fondo acogido. Reclamo de ilegalidad. Rechazo a la solicitud de giro de patente comercial, por problemas de zonificación y de conformidad con el artículo 26 del D.L. Nº3.063. Infracción a artículos 342 y 346 del Código de Procedimiento Civil. Cumplimiento de los requisitos establecidos en los artículos 25 y 26 de la Ley de Rentas Municipales y en concordancia con los artículos 1.700, 1.702 y 1.706 del Código Civil.

Administrativo

Recurso de Casación en el Fondo rechazado. Expropiación. Transgresión de los artículos 9º letra B) del D.L. Nº2.186; 341, 342 Nº3,384 regla 2º y 425 del Código de Procedimiento Civil; y 1698, 1700 y 1702 del Código Civil. Sentenciadores le agregaron un requisito no contemplado.

Recurso de Casación en el Fondo rechazado. Expropiación. Reclamación. Artículo 9º letra b) del D.L. 2186 en relación con el artículo 19 del Código Civil, y 1698 de este último texto legal. Terreno no expropiado resulta prácticamente imposible de explotar o aprovechar como consecuencia o efecto de la expropiación.

Recurso de Apelación acogido en cuanto a la legitimación pasiva y rechazado en cuanto a la indemnización. Demanda de indemnización de perjuicios por falta de servicios en contra del Fisco de Chile. Funcionarios que trabajaban en el Servicio de Impuestos Internos y del Servicio Nacional de Aduanas, es decir agentes que trabajan para el Estado, posibilitaron la actuación ilícita. Disposiciones constitucionales, artículos 1º, 6º, 7º inciso final, 38 inciso 2º y la Ley 18.575. insuficiencia de pruebas para indemnizar.

Constitucional

Recurso de Apelación de Protección acogido. Vulneración de la garantía de igualdad ante la ley contemplada en el artículo 19 Nº 2 de la Constitución Política de La República. Proceder por vías de hecho a ocupar la hijuela que estiman les pertenece, alteraron una situación fáctica existente por varios años -desde 1979 aproximadamente-, apartándose de la legalidad vigente.

Tributario

Recurso de Casación en el Fondo rechazado. Juicio Tributario. Infracción a los artículos 31 Nº6 de la Ley de Impuesto a la Renta, y artículos 21 y 26 del Código Tributario. Falta de aplicación, aplicando, en cambio, erróneamente el artículo 33 Nº1 letra B) de la Ley de la Renta.

Recurso de Casación en el Fondo rechazado. Juicio Tributario. Infracción a los artículos 14 letra A) Nº 1, 21 y 33 Nº1 de la Ley de Impuesto a la Renta, 21 del Código Tributario y 19 del Código Civil. La norma establece como regla general, que las rentas provenientes de las empresas, individuales o colectivas, se afectarán con los Impuestos Global Complementario o Adicional, cuando efectúen retiros o distribuciones a sus propietarios, socios o accionistas.

Recurso de Casación en la Forma y en el Fondo rechazados. Juicio Tributario. Artículo 768 Nº1 del Código de Procedimiento Civil, consistente en haber sido la sentencia pronunciada por un tribunal incompetente o integrado en contravención a la ley. Delegación de funciones jurisdiccionales. La incompetencia debió ser alegada en otra etapa del juicio.

Recurso de Apelación. Nulidad declarada de oficio por el tribunal. Juicio Tributario. Delegación de funciones jurisdiccionales. Artículos 6º, letra B, Nº 7 y 116 del Código Tributario, y 20 de la Ley Orgánica del Servicio de Impuestos Internos.

Procesal

Recurso de Hecho declarado inadmisible. Recurso de Queja en contra de juez árbitro. Artículo 63 Nº1 letra c) del Código Orgánico de Tribunales y 188 del mismo cuerpo legal. Sentencia pronunciada respecto de este recurso, en contra de un juez árbitro es inapelable.

Penal

Recurso de Casación en el Fondo rechazado. Juicio Criminal. Cuasidelito de lesiones. Causal del Nº 3 del artículo 546 del Código de Procedimiento Penal. Sentencia de autos ha calificado como delito un hecho que la ley penal no considera como tal. Al respecto, señala que ha contravenido los números 8 y 16 del artículo 198, en relación a los artículos 138 y 139 de la Ley de Tránsito.

Recurso de Casación en el Fondo rechazado. Juicio Criminal. Cuasidelito de lesiones graves. Demanda.de indemnización de perjuicios. Infracción a los artículos 459, 485 y 488 del mismo precepto legal, y los art ículos 490 y 492 del Código Penal.

Juicio Criminal. Delito de abusos deshonestos sancionado en el artículo 366 bis del Código Penal. Causal 1a. y 7a. del artículo 546 del Código de Procedimiento Penal. Sentencia aunque califica el delito con arreglo a la ley impone al delincuente una pena más o menos grave que la designada en ella, cometiendo error de derecho.

Recurso de Casación en el Fondo rechazado. Juicio Criminal. Cuasidelito de homicidio. Infracción a los artículos 456 bis, 460 y 471 y siguientes del Código de instrucción criminal; 490 y 492 del Código Penal y 55, 114, 127. 148, 149, 167, 170, 171, 172, 174, 175 de la Ley de Tránsito. Accidente ocurrió única y exclusivamente por la despreocupación de la víctima.
