ISO Lawyers: Japan Bar Required
It's hard to imagine anyone wishing for more lawyers. But apparently, that's what is happening in Japan, which has set a goal to add more lawyers (Chicago Sun Times 8/21/06). According to the article,  Japan has roughly 22,000 lawyers -- one for every 5,790 people, compared with one for every 268 in the United States. Under the old bar exam, to be scrapped in 2011, fewer than 1,500 people (roughly 3 percent of all takers) are allowed to pass every year. But that will be changing soon. From the article:

In the most sweeping reform of Japan's legal system since World War II, the doors are opening wide for a flood of new lawyers to handle cases in an increasingly litigious society.Experts say the reforms underscore a big shift in social attitudes that is forcing Japan to change its policy of keeping the number of lawyers low.''People are beginning to take more and more of their troubles to court,'' said Hideaki Kubori, a corporate lawyer. ...

Economic necessity is the driving force behind the push for more lawyers. Kubori noted that filings for personal bankruptcy have jumped more than fivefold over 10 years. Inheritance and divorce disputes are also going to court.

Attrition in Associates Leads to Attrition in Law Firm Marketing
Interesting post from Larry Bodine about how the associate attrition problems that I blogged about last week are taking a toll on lawyer marketing efforts. Apparently, because few lawyers see themselves as making partner or don't care about partnership as a goal, they're not particularly interested in marketing. To quote Bodine, "It's impossible to market a service that you don't want to perform."

Bodine also writes about the tension between different generations of associates when it comes to marketing:

Generation X, associates aged 27 to 41, are loners who question authority, can be cynical, pessimistic, think in short time horizons and have a "prove it to me" attitude, according to author and consultant Cam Marston, of Marston Communications in Charlotte, N.C.   Add Generation Y to the mix, aged 26 or younger, who are "adultolescent" individuals who have never known hardship, yet stressed, at a young age, and may have huge goals but are clueless on execution.  They don't want to be like the people who are in charge of the firm, the Baby Boomers who have a strong work ethic, are competitive, optimistic and show success visibly with trophies and plaques.

And Baby Boomer lawyers are becoming increasingly frustrated about the younger generation's reluctance to step up to the plate and take on res ponsibilities that Boomers had at their age -- including marketing.

Much of Bodine's post makes sense to me. But law was also different when the Boomers started out: Back then, hard work would get lawyers a partnership and lawyers weren't required to market as much. Are Boomers' demands of the younger generation sensible? Or are they expecting younger lawyers to more than was required of Boomers when they started their career? And more broadly, is the practice of law at large firms harder today than it was 20 or 30 years ago -- and if so, why?

How Not to Correct Appellate Error
Mike Cernovich of Crime and Federalism posts here about recent appellate error -- committed by an attorney, not the judges. Attorney Kevin Carlucci filed a notice of appeal in a criminal case and learned from the court that the notice was defective. Here's what happened next:

When the District Court notified him of a possible error, however, Carelock's counsel acknowledged that he took no immediate action that corrected the problem. He stated that upon receiving notification of an error from the Court, he reviewed a printout copy of the notice of appeal (the one that bore Carelock's name and information) and concluded that there was nothing wrong. At this time, Carelock's counsel neglected to review the document that he had actually electronically filed with the District Court.

According to Cernovich, Carlucci's mistake was fairly easy to make, the equivalent of a typo. Apparently, he filed the cover sheet from another case with the court. But Carlucci didn't fix the error until 90 days later, when it was too late -- and too bad for the client, whose appeal was apparently dismissed.

Cernovich's lesson: Always listen to the clerk, before a tiny mistake causes big problems.

If Macs Are This Good, Shouldn't More Lawyers Be Using Them?
Grant Griffiths of Home Office Lawyer, in a guest post debut at Future Lawyer, shares this interesting  statistic about Macintosh computers and their resistance to viruses:

By the end of 2005, there were 114,000 known viruses for PCs. In March 2006 alone, there were 850 new threats detected against Windows. Zero for Mac. While no computer connected to the Internet will ever be 100% immune from attack, Mac OS X has helped the Mac keep its clean bill of health with a superior UNIX foundation and security features that go above and beyond the norm for PCs.

If this is true, it would seem that there should be a greater push within the legal community towards Macintosh usage. I know that one of the impediments is that programs like Word Perfect, still dominant amongst lawyers, are not compatible with the Mac's Operating System. And the Mac still costs slightly more than other types of computers.

Are there are reasons why more lawyers haven't transitioned to the Mac? I'll admit that my preference for Word Perfect has kept me tethered to an MS operating system, even though my first machine in law school, back in 1987 was a Mac (it was destroyed in a flood a few years later, and I couldn't afford a new one). Or, should Apple do more to capture the lawyer market by making Macs available at low prices to law students to get them addicted to Mac (just as they are addicted to Lexis or Westlaw)?

El mundo empresarial está descubriendo los blogs o weblogs (bitácoras en línea), lo cual podría contribuir a generalizar su aceptación y a transformar la cultura de buena parte del mundo del trabajo, al igual de lo que pasó con el correo electrónico y las mensajerías instantáneas

Hay medio millón de blogs hoy en día. Cuando escribimos una primera nota al respeto hace un año, la cifra era de 150.000. El fenómeno confirma la fascinación de la gente por la posibilidad de escribir y expresarse en la red, más todavía que por la facultad de leer o informarse.
Pero uno se pregunta ¿qué tiene que ver las confidencias íntimas y personales comunes en estos diarios en línea con el mundo de los negocios? De hecho hay todo tipo de blogs y tantas definiciones como bloggers, o escritores de blogs. Para el mundo empresarial, cuatro características en particular presentan marcado interés: suelen (no todos) ser escritos por personas que siguen un tema y comparten conocimiento en la web; ofrecen enlaces a páginas o sitios de interés y sirven de filtro; expriman puntos de vistas personales escritos de manera fresca, mucho menos formal que la comunicación empresarial tradicional lo cual alienta la interactividad.

Macromedia
Una de las apropiaciones más recientes de los blogs por el mundo empresarial se dio a fines de abril cuando cuatro dirigentes de Macromedia abrieron bitácoras personales. Instrumentan una verdadera "estrategia blog" para acompañar el lanzamiento de nuevas versiones de cuatro de sus productos entre los cuales Flash y Dreamweaver. Les permite interactuar con los desarrolladores y con el público explicándoles en dado caso algunas propiedades del programa.

Macromedia deja que sus ejecutivos se expresen libremente, solo les pide que se limiten a temas relacionadas con el producto. Uno de ellos, John Dowdell advierte: "Este es un sitio personal con puntos de vista subjetivos sobre noticias calientes... si quiere la noticia oficial, la encontrará en el sitio de Macromedia." Para dar coherencia a esta decisión estratégica, los blogs no están en el sitio de Macromedia ni en ningún subsitio de la empresa.

Ideactif
Ideactif, una empresa quebequesa de diseño de sitios web especializada en la 'usabilidad', empezó un weblog colectivo en enero del 2000. Explica su intención de la manera siguiente: "Estamos conectados en permanencia a la web y con frecuencia descubrimos informaciones que pueden ser útiles, provocar la reflexión o sencillamente ser divertidas. El weblog es un medio que permite compartir conocimientos de manera sencilla y eficaz."

Les sirve para mostrar que siguen al tanto de lo que pasa en su campo. En vez de un sitio estático como un panfleto publicitario, tienen un espacio constantemente renovado en el cual uno encuentra información relevante, seleccionada por profesionales.

Otros ejemplos

Los blogs no sirven solamente para las relaciones con el exterior. Es un instrumento más para compartir el conocimiento interno. Para la consultora en informática Amy Wohl, los weblogs "son interesantes porque son una manera no molesta de permitir que los trabajadores compartan el proceso mediante el cual buscan, analizan y seleccionan información." Puede ser un instrumento útil para empleados que trabajan en equipo o sobre un proyecto particular.
Arthur Hissey, director ejecutivo de la consultaría australiana Computer Research and Technology, estima que "un blog escrito por un especialista en un campo particular puede servir como excelente señal de alarma." También recomienda su uso para seguir las actividades de las empresas rivales.

El campo de las bitácoras electrónicas empresariales sigue siendo fundamentalmente virgen. Pero uno ve aparecer con considerable velocidad propuestas para que los usen agencias de viaje (para discutir de los lugares de destino), abogados (para consejos informales), periodistas independientes (para dejar a conocerse como especialistas de algún tema) y, de manera más general, cualquier empresa, pequeña o grande que vende conocimiento.

La fuerza de atracción considerable de los blogs proviene del hecho que sirven de puente entre la expresión personal, tal como se encuentra en el correo electrónico y la mensajería instantánea, y el motor de búsqueda en la medida en la cual permiten acceder a una información filtrada por especialistas humanos.

Civil

Recurso de Casación en el Fondo rechazado. Juicio ordinario de indemnización de perjuicios. Transgresiones a los artículos 170 del Código de Procedimiento Civil y 1698 del Código Civil. Dar por establecida la existencia del daño moral, sin que el proceso suministre pruebas que sirvan de fundamento a tal determinación. Cuestión de hecho que les compete privativamente.

Recurso de Casación en el Fondo acogido. Juicio ordinario de indemnización de perjuicios. Aplicación incorrecta a la materia controvertida las normas concernientes a la responsabilidad extracontractual. Evidente error de derecho, haciendo una falsa aplicación de la normativa referente a la responsabilidad extracontractual entre la que figura el artículo 2314 del Código Civil.

Recurso de Casación en el Fondo y en la Forma rechazado. Juicio ordinario de nulidad de contrato. Infracción al artículo 1687 del Código Civil afirma-, toda vez que pretende darle validez a un acto inserto en una promesa de compraventa y arrendamiento. Acción intentada por el actor parte de un supuesto de hecho diverso del establecido por los jueces del fondo.

Recurso de Casación en el Fondo y en la Forma rechazado. Requerimiento de acuerdo a la Ley General de Bancos. Infracción a los artículos 723, 1445 y 1446 del Código Civil. No puede ser poseedora del inmueble por se menor de edad. Basta la inscripción para que se adquiera la posesión, aunque el poseedor no entre realmente en el goce de la cosa a que la inscripción se refiere.

Recursos de Casación en el Fondo y en la Forma rechazados. Juicio Ordinario. Resolución de contrato de compraventa. Vicio de ultrapetita contemplado en el artículo 768 Nº4 del Código de Procedimiento Civil. El medio de prueba denominado presunciones ha llevado a los sentenciadores a concluir que la percepción de los dineros.

Laboral

Recurso de Casación en el Fondo rechazado. Juicio Laboral. Vulneración de los artículos 152, 430, 431 y 432 del Código de Procedimiento Civil; 6 y 7 de la Constitución Política de la República; 2, 3, y 8 de la Ley Nº 18.575, Decreto Ley Nº 3.502, 2 del DFL Nº 17 y 8 de la Ley Nº 18.889. Abandono de procedimiento. Normas de carácter adjetivas, las que no se pueden impugnar a través del recurso en estudio.

Recurso de Casación en el Fondo acogido. Juicio Laboral. Prácticas antisindicales. Quebrantamiento de los artículos 1.545, 1.560 y 1.563 del Código Civil, 4, 221 y 231 del Código del Trabajo. Hechos no pueden considerados como prácticas antisindicales.

Recurso de Casación en la Forma acogido, en el Fondo, tenido por no interpuesto. Juicio Laboral. Causal del artículo 768 Nº 4 del Código de Procedimiento Civil, esto es, en haberse otorgado más de lo pedido o extendiéndose la sentencia a puntos no sometidos a la decisión del tribunal, la que ocurre, aún cuando la actora no exigió el pago de la indemnización del artículo 87 de Estatuto Docente, la ordenaron.

Recurso de Casación en el Fondo rechazado. Juicio Laboral. Terminación de los contratos de trabajo de los actores injustificada. Infracción a las normas de la Ley Nº 18.175, específicamente a sus artículos 131, 143 y 147 y siguientes y, artículos 2.471 y 2.472 del Código Civil. Alegaciones formuladas por la recurrente carecen de influencia en lo que se ha resuelto en autos.

Administrativo

Recurso de Casación en el Fondo rechazado. Demanda de indemnización de perjuicios por responsabilidad extracontractual y falta de servicio. Fallo transgredió lo dispuesto por el artículo 2518 del Código Civil en orden a que la prescripción extintiva se interrumpe mediante la demanda judicial. Jueces del fondo dieron estricta aplicación a las disposiciones legales atinentes a la materia, que se han examinado.

Penal

Recurso de casación en el Fondo acogido. Juicio Criminal. Cuasidelito de homicidio. Infracción a los artículos 303 y 254 Nºs. 2 y 5 del Código de Procedimiento Civil. El fallo efectúa consideraciones respecto de las excepciones dilatorias opuestas por los demandados, infringiendo ambas disposiciones. Aplicación errónea los numerales 2 y 5 del artículos 254 del Código de Procedimiento Civil

Recurso de Casación en el Fondo rechazado. Juicio Criminal. Delito de celebración de contrato simulado. Artículo 470 Nº 1 del Código Penal, al calificar como lícito un hecho que la ley sanciona como delito. Causal 3º del artículo 546 del Código de Procedimiento Penal, ella resulta del todo insuficiente para reveer los hechos de la causa, al no investir de facultad a esta Corte para revisarlos.

Recurso de Casación en el Fondo rechazado. Juicio Criminal. Cuasidelito de lesiones. Infracción a los artículos 456 bis, 457, 459, 473, 484 bis A del Código de Procedimiento Penal, 1, 10 Nº 8, 14, 15, 490 y 492 del Código Penal, y por falta de aplicación las disposiciones de los artículo 167 Nº 1, 2, 3, 4 y 8; y 176 de la ley 18.290. No se indicaron determinadamente las causales que le sirven de fundamento.

Recurso de Casación en el Fondo rechazado. Juicio Criminal. Delito de tráfico de estupefacientes de la Ley Nº 18.403. Errónea aplicación de las normas contenidas en los artículos 1º y 5º de la Ley 18.403. Determinación de los hechos de la causa fueron guiados en la dirección que los medios probatorios precisamente les brindaron y conforme se los autorizaba el artículo 20 de la Ley 18.403.

Recurso de Casación en el Fondo rechazado. Juicio Criminal. Cuasidelito de homicidio. Infracción a los artículos 492 del Código Penal, 188 de la Ley Nº 18.290 y 488 del Código de Procedimiento Penal. Los hechos de la causa han de tenerse por inamovibles.

Recurso de Casación en el Fondo. Sentencia anulada de oficio por el tribunal. Juicio Criminal. Delito contemplado en el artículo 5º de la ley 19.366. Se ha castigado una conducta que propiamente no constituye delito al faltar la tipicidad y culpabilidad, lo que conlleva la infracción del artículo 1º del Código Penal. El hecho establecido por las sentencias de autos, corresponde sea calificado de acuerdo a las nuevas prescripciones del artículo 4º de la ley 20.000.

Recurso de Casación en el Fondo rechazado. Juicio Criminal. Delito previsto y sancionado en el artículo 97 Nº 4, inciso 2º del Código Tributario. Infracción a los artículos 456 bis y 274 Nºs. 1 y 2 del Código de Enjuiciamiento Criminal; 15 Nº1 del Código Penal y 97 Nº4 inciso segundo del Código Tributario. Leyes reguladoras de la prueba. Quedan firmes los hechos establecidos por los sentenciadores de mérito.

Recurso de Casación en el Fondo rechazado. Juicio Criminal. Delito de robo con violencia. Infracción de los artículos 456 bis Nº 3 del Código Penal, en segundo término se ha invocado la del Nº 2 de la misma norma del Código Adjetivo Criminal. Calificación equivocada del delito, aplique la pena en conformidad a esa calificación. La pretendida vulneración de dicha disposición no influye en lo dispositivo del fallo.

Recurso de Casación en el Fondo rechazado. Juicio Criminal. Delito de injurias. Causal 4del artículo 546 del Código de Procedimiento Penal, esto es, en que la sentencia, calificando como lícito un hecho que la ley pena como delito, absuelve al acusado. Insuficiencia de la causal para modificar los hechos de la causa.

Recurso de Casación en el Fondo rechazado. Juicio Criminal. Cuasidelito de lesiones. Infracción a las normas del artículo 490 Nº 2 y 492 del Código Penal, en relación con los artículos 1, 2, 101, 114, 143, 144, 148, 149 y 172 Nºs. 2, 3, 7, 10 y 13 de la Ley Nº18.290 sobre el Tránsito. No se invocó la norma pertinente que permita a esta Corte entrar a emitir pronunciamiento sobre el recurso deducido.

Recursos de Casación en la Forma y en el Fondo rechazados. Juicio Criminal. Cuasi delito de homicidio. Infracciíon a los artículos 456 bis, 473 y 457 del Código de Procedimiento Civil. Es correcta la aplicación que de la ley penal han efectuado los jueces de instancia.

Recurso de Casación en el Fondo rechazado. Juicio Criminal. Delito contemplado en el artículo 9 del D.L. 2.695. Para la aplicación de las penas se exige la concurrencia de dos requisitos, la comisión de hechos ilícitos, y que ellos se cometan durante la tramitación administrativa. Por la sentencia dictada en su contra, no se le ha atribuido ningún delito.

Recurso de Casación en el Foindo rechazado. Juicio Criminal. Delito de tráfico de sustancias estupefacientes. Artículos 1º y 5º de la ley 19.366, como asimismo las normas del artículo 456 bis, 488 del Código de Procedimiento Penal y 36 bis de la citada ley 19.366. No existen transgresión de la leyes reguladoras de la prueba.

LUGARES EN LOS CUALES NO SE PUEDE FUMAR

Está totalmente prohibido fumar en:

  • Establecimientos de educación prebásica, básica y media.
  • Recintos donde se expendan combustibles.
  • Lugares donde se fabriquen, procesen, depositen o manipulen explosivos, materiales inflamables, medicamentos o alimentos.
  • Medios de transporte de uso público o colectivo.
  • Ascensores.

Está prohibido fumar en los siguientes lugares, salvo en sus patios y espacios al aire libre:

  • Al interior de los recintos o dependencias de instituciones públicas. Sólo se podrá fumar en el caso de oficinas individuales que cuenten con ventilación hacia el aire libre o extracción del aire hacia el exterior.
  • Establecimientos de educación superior.
  • Establecimientos de salud.
  • Aeropuertos y terrapuertos.
  • Teatros, cines, lugares en que se presenten espectáculos culturales y musicales, salvo que sean al aire libre.
  • Gimnasios y recintos deportivos.
  • Supermercados, centros comerciales y demás establecimientos similares de libre acceso al público.

En éstos, podrá existir una o más salas habilitadas para fumar, salvo en los establecimientos de salud.

Estas mismas reglas se aplicarán en empresas, establecimientos, faenas o unidades económicas obligadas a confeccionar un reglamento interno de orden, higiene y seguridad, en conformidad a las normas del Código del Trabajo.

En los lugares de trabajo de propiedad de particulares no comprendidos en los mencionados anteriormente, la existencia de prohibición de fumar o la determinación de sitios y condiciones en que ello se autorizará, serán acordadas por los respectivos propietarios o administradores, oyendo el parecer de los empleados.

Lugares de esparcimiento:

En restoranes, bares, pubs, discotecas, cabarets, casinos de juego y demás establecimientos similares, con una superficie superior a 100 metros cuadrados, para fumar en su interior se deberá separar ambientes para fumadores y para no fumadores, no pudiendo el espacio reservado a estos últimos representar menos del 60% del espacio total destinado a atención de público.

En lugares con una superficie inferior a 100 metros cuadrados se podrá optar por ser un espacio para fumadores o para no fumadores, de lo que deberá informarse en su acceso.

Los espacios habilitados para fumadores deberán estar aislados y contar con mecanismos que impidan el paso del humo hacia el resto del recinto, ventilación hacia el aire libre o extracción del aire hacia el exterior, y a ellos no se permitirá la entrada de menores de 18 años.

'Cuba: Sweet 15'

Robin Thom had the good fortune to be on the right balcony at the right time in order to capture this lovely scene on the Paseo de Prado in Havana, Cuba. "I had always assumed this was a wedding," writes Robin on his Flickr page, "but it was pointed out that this may be the celebration of the coming of womanhood." Wikipedia tells us this celebration is called the "Quinceañera", or Quince Años (Spanish for fifteen years), and is observed in parts of Latin America (the word "Quinceañera" can also refer to the subject of the celebration):

Fifteenth birthday celebrations were very popular in Cuba until the late 1970s. The custom entered the country partly via Spain, but its major influence was French. Wealthy families, who could afford to rent luxurious halls at country clubs or 4/5-star hotels and to hire choreographers, were the actual pioneers of Quinceañeras. Although lower-income families could not afford the same display of wealth, they too started to celebrate Quinceañeras, which they called Quinces. Those celebrations usually took place at the home of the Quinceañera or at the more spacious house of a relative.

While this traditional celebration is still practiced nowadays in Latin America and Latino communities in North America, it is sometimes observed by other events that focus more on the quinceañera's wishes (e.g. world travelling). In some cities, the more proper Baile de las Debutantes (Debutantes' Ball) still survives.

In Tobacco Conspiracy, Lawyers Were Key
Raise your hands when you are done. I'll give you another moment to finish reading U.S. District Judge Gladys Kessler's 1,653-page opinion (1,742 pages counting appendices) and 18-page order finding that the nation's top cigarette makers violated federal racketeering laws and deceived the public about the health hazards of smoking.

Ready now? Well, in case you overlooked it, Blog 702 points out that Judge Kessler's ruling included this indictment of the complicity of lawyers in helping to deceive the public:

"Finally, a word must be said about the role of lawyers in this fifty-year history of deceiving smokers, potential smokers, and the American public about the hazards of smoking and second hand smoke, and the addictiveness of nicotine. At every stage, lawyers played an absolutely central role in the creation and perpetuation of the Enterprise and the implementation of its fraudulent schemes. They devised and coordinated both national and international strategy; they directed scientists as to what research they should and should not undertake; they vetted scientific research papers and reports as well as public relations materials to ensure that the interests of the Enterprise would be protected; they identified 'friendly' scientific witnesses, subsidized them with grants from the Center for Tobacco Research and the Center for Indoor Air Research, paid them enormous fees, and often hid the relationship between those witnesses and the industry; and they d evised and carried out document destruction policies and took shelter behind baseless assertions of the attorney client privilege.

"What a sad and disquieting chapter in the history of an honorable and often courageous profession."

The ruling overall "sounds rather a lot like a parent confronting a dishonest child," says William G. Childs at TortsProf Blog. If so, the question may be whether any of the complicit lawyers will get taken to the woodshed.

Five Bold Objectives

In an Office Solutions article, Tom rants: I am an avowed incrementalist. Try, test, and experiment are among my favorite words. I still fervently believe that a pragmatic, incrementalist approach to progress is sound. But I also believe the visions to which we aspire must be grand ones. Not so much because inspiring visions are superb motivators, which they are, but because we must markedly pick up the pace of change in our businesses. If we don't, we face the prospect of a permanently reduced standard of living.

Bold Objective No. 1: Speed of innovation
Whether retailer, banker, or science-based company, reduce your product development cycle time--this year--by 50 percent. If we are to master the new competitive environment, shortening the product development cycle is imperative in every industry.

Bold Objective No. 2: Premium products
Through service, quality, and enhanced innovation, shift your product or service portfolio to differentiated, higher price, and higher value-added plateaus immediately. The specialty steel, specialty retail, specialty chemical, and specialty forest product companies outperform the diversified and generalist members of their industries by 50 percent or more.

Bold Objective No. 3: People and organization
Reduce the number of layers of management at any operating activity to two. Pare corporate staff by 80 percent; eliminate all first-line supervision jobs; get 100 percent of the people on the payroll into a profit-sharing program.

Bold Objective No. 4: Paperwork reduction
Reduce the paperwork and procedures in every operation by half.

Bold Objective No. 5: Time and attention
This year, devote fully half of your time to the single strategic priority that is most vital for you to achieve lasting distinction in your markets. Visit the customers--visit the stores!

Any of these five goals is imposing, especially for an old or large firm. Yet, I strongly believe these or like objectives are essential to the survival of most firms, whether they are high- or low-tech, service or manufacturing.

What's it about? Here's Tom's explanation of the origin of the first section:
A frustrated participant at a seminar for investment bankers in Mauritius listened impatiently to my explanation of differences of opinion among me, Mike Porter, Gary Hamel, Jim Collins, etc. Finally, he'd had enough. "What, if anything," he asked, "do you believe 'for sure'?" I mumbled something, but his query started rumbling around in my mind. Three days later, wandering on a Sunday in London, the idea of "the irreducibles" occurred to me--and I started jotting down notes on stuff I do indeed believe "for sure." Before I knew it, a few days later, the list had grown to 209 items. Hence "The Irreducible209" that follows.

In addition to "The Irreducible209," this new master set also contains "Sales122" and "60TIBs." While many of the slides are duplicates from the "Re-imagine" master set, Tom's been getting great responses to the new material he's added. He calls this new base presentation "the resurrection of Excellence as raison d'etre." Hence the title "X [short for Excellence] Always."

Wow! Project
Red Cross Community Response Teams

Every Friday, the Mali Red Cross team from Kouremale, a group of 15, hold a meeting to train in first aid and practice what they have learned. Beginning in February of 2006, training small groups of individuals (10-35 people) became a priority in the region along the border of Mali and Ivory Coast, as it had become a haven for waves of refugees. Community members were culled to participate in the training, which included first aid and disaster response.

Groups like the one in Kouremale were not only given first aid basics, but also made aware of the importance of being prepared, and of acting together as a team. Playing different roles, and understanding the importance of each one, has helped these small groups operate more efficiently in a place where efficiency is of utmost importance. After all, if one has few resources (material, time, personnel) to begin with, squandering them is not an option.

Creating these Community Response Teams was in and of itself a Wow! Project. At the core of the effort was a focus on having the right team of people focus on the roles that they play best, and playing them to the best of their ability. This is true of every Wow! Project. To really make the work sizzle, the right people must be performing an aspect of the work that they feel most comfortable with. Meanwhile, they must allow the other members of the team to make up for what they might be neglecting while focused on their strong point. The compilation of a team needs to account for every aspect of the project, requiring members that have different skills that complement each other. Who hasn't heard of "too many chiefs, not enough Indians"? That applies to teams that have an imbalance in the way of leaders/motivators, but not enough thinkers/teamworkers/implementors/finishers.

As a team management tool, the Belbin Assessment helps identify each team member's preferred role. One person may be great at coming up with innovative solutions to problems, but might not be so keen on keeping an eye on the details of the finished product. Someone else on the team might spot those small errors, but not really be up to the task of motivating others to work together. Putting together a team of individuals with strengths that balance weaknesses ensures the maximum efficiency possible on any project, not just relief efforts in Mali.

A Better Test for Proving Pretext?
For employment lawyers, the test for establishing pretext in discrimination cases can be elusive, to say the least. At Jottings By An Employer's Lawyer, Michael W. Fox likes the test set out last week by the 7th U.S. Circuit Court of Appeals in Yindee v. CCH Inc. As Fox quotes the opinion:

"[O]nce a non-retaliatory explanation has been articulated, the plaintiff must show that this explanation is a pretext for discrimination. To do this the employee must establish that the explanation is a lie, which permits a jury to infer that the tale has been concocted to conceal an unlawful truth. ... It is not enough to demonstrate that the employer was mistaken, inconsiderate, short-fused, or otherwise benighted; none of those possibilities violates federal law. ... Poor personnel management receives its comeuppance in the market rather than the courts."

The emphasis in that quote comes not from the court but from Fox, who comments: "The direct language of Judge Easterbrook set out in bold above, is, or should be, at the heart of any motion where pretext is an issue -- did the employer lie?"

Letters Debate E-Discovery Snafu
Monica Bay continues to cover the e-discovery snafu that may have compromised electronic discovery in the Enron litigation, as first reported last week by Ben Hallman in The American Lawyer. On Friday, Bay posted a letter responding to the article from Scott Nagel, vice president and managing director of LexisNexis Applied Discovery, the company at the center of the report. In it, Nagel addresses what he sees as factual errors in the original report. For one,  he says, the so-called bug in Microsoft Outlook 2003 did not erase anything.

"No data was lost as a result of this bug. It did not erase anything but simply caused the text of e-mails to not be displayed. The data is present and can be viewed by applying Microsoft's patch to address the error."

The problem, Nagel adds, affected less than .01 percent of Enron e-mails.

Bay also conveys further thoughts from EDD consultant Craig Ball -- who was quoted in the original article -- in the form of his letter to Marc Osborn, a member of the LexisNexis PR staff. In response to a LexisNexis statement suggesting that Microsoft did not patch the Outlook bug until the September 2005 release of Service Pack 2, Ball writes:

"In fact, the Microsoft Outlook Hotfix to resolve this issue was (per Microsoft's website) released on January 7, 2004 and the issue involving blank Outlook e-mails was also addressed by a patch in the July 27, 2004 MS Office 2003 Service Pack 1. ...

"It's no doubt technically accurate to say that the fix was also carried forward into Service Pack 2 in 2005, but don't you want to be forthcoming about the two prior patches that would have solved the problem, perhaps as much as eighteen months earlier?"

Time will tell whether this problem could easily have been avoided, says legal technology consultant Ron Friedmann, but in the meantime, "it's a good lesson that litigators and lit supp managers should make sure the tools they use work appropriately."

Instruction Book for Managing Partners
Congratulations! Your firm has voted you managing partner. As the initial elation dies down, you face the inevitable question: Now what do I do?

You turn, of course, to the instruction book "First 100 Days: Transitioning a New Managing Partner." According to its author, Patrick J. McKenna, this free e-book "provides prescriptive counsel to new firm leaders on what actions they might consider as they begin undertaking their initial responsibilities." Some of the advice offered in this book may strike you as obvious. For example:

  • "Build a working relationship with the departing Managing Partner."
  • "Create constructive dialogue with key thought leaders and power brokers within your firm."
  • And my favorite: "Figure out what you need to know and learn it as rapidly as you can."

But, as the book reminds, a new leader's honeymoon is brief. While some of the advice in this book may seem obvious, the book's first half offers a useful checklist for new managers as they plan their initial and longer-term actions.

Of greater interest is the book's second half, "Voices of Experience." It compiles the thoughts and advice of those who know of what they speak -- the managing partners of leading law firms such as Baker Donelson, Baker & McKenzie, Crowell & Moring, Ice Miller, McCarter & English, Morgan Lewis, Patton Boggs and Ropes & Gray.

The book is earning kudos from legal bloggers. Bruce McEwen at Adam Smith, Esq. calls it "both short, and terrific -- an easy on line read in one sitting." Ernest Svenson at Ernie the Attorney says McKenna offers "useful observations about law firm management." David Maister relates that even clients outside the legal profession "agreed that it's incredibly useful and well-written."
