The nation's largest insurers, hospitals and medical groups have hired more than 350 former government staff members and retired members of Congress in hopes of influencing their old bosses and colleagues, according to an analysis of lobbying disclosures and other records.

The tactic is so widespread that three of every four major health-care firms have at least one former insider on their lobbying payrolls, according to The Washington Post's analysis.

Nearly half of the insiders previously worked for the key committees and lawmakers, including  Sens. Max Baucus (D-Mont.) and  Charles E. Grassley (R-Iowa), debating whether to adopt a public insurance option opposed by major industry groups. At least 10 others have been members of Congress, such as former House majority leaders Richard K. Armey (R-Tex.) and Richard A. Gephardt (D-Mo.), both of whom represent a New Jersey pharmaceutical firm.

The hirings are part of a record-breaking influence campaign by the health-care industry, which is spending more than $1.4 million a day on lobbying in the current fight, according to disclosure records. And even in a city where lobbying is a part of life, the scale of the effort has drawn attention. For example, the Pharmaceutical Research and Manufacturers of America (PhRMA) doubled its spending to nearly $7 million in the first quarter of 2009, followed by Pfizer, with more than $6 million.

The push has reunited many who worked together in government on health-care reform, but are now employed as advocates for pharmaceutical and insurance companies.

A June 10 meeting between aides to Baucus, chairman of the Senate Finance Committee, and health-care lobbyists included two former Baucus chiefs of staff: David Castagnetti, whose clients include PhRMA and America's Health Insurance Plans, and Jeffrey A. Forbes, who represents PhRMA, Amgen, Genentech, Merck and others. Castagnetti did not return a telephone call; Forbes declined to comment.

 

Also inside the closed committee hearing room that day was Richard Tarplin, a veteran of both the Department of Health and Human Services and the Senate, where he worked for  Christopher J. Dodd (D-Conn.), one of the leaders in fashioning reform legislation this year. Tarplin now represents the American Medical Association as head of his own lobbying firm, Tarplin Strategies.

"For people like me who are on the outside and used to be on the inside, this is great, because there is a level of trust in these relationships, and I know the policy rationale that is required," Tarplin said in explaining the benefits of having government experience.

But public interest groups and reform advocates complain that the concentration of former government aides on K Street has distorted the health-care debate, and that it further illustrates the problem posed by the "revolving door" between government and private firms.

"The revolving door offers a short cut to a member of Congress to the highest bidder," said Sheila Krumholz, executive director of the Center for Responsive Politics, which compiled some of the data used in The Post's analysis. "It's a small cost of doing business relative to the profits they can garner."

Aides to Baucus and other lawmakers bristle at any suggestion of special treatment for former staff members. Baucus spokesman Scott Mulhauser said the senator "remains committed to working with a variety of stakeholders" as the Finance Committee attempts to come up with a bill this summer.

"The senator and his staff meet daily with individuals, nonprofits and interests from across the health-care spectrum, and are proud that all interests are treated equally and that no one receives special treatment of any kind," Mulhauser said. "As a result, the Finance Committee has been praised by members of Congress and the media for its uniquely inclusive and transparent health-care reform process."

'Ghana: Bloggers Discuss Business Process Outsourcing'

Few know that A.T.Kearney rated Ghana as sub-Saharan Africa's number one Business Process Outsourcing (BPO) destination in 2005 and, as of June 2009, the nation's achievements in this field look set to continue. Several bloggers reported on an agreement signed in early June between two leading ICT organisations that will provide unprecedented opportunities for ICT students, create thousands of jobs, and underpin the growth of this nascent industry.

Mr Eddie Turkson reported on the details of the agreement:

"THE Ghana Telecom University College (GTUC) has signed a partnership agreement with Rising Data Solutions Limited (RDS), a business process outsourcing (BPO) company, to train people and create jobs in the Information and Communications Technology (ICT) industry.

Under the agreement, RDS will provide a curriculum and logistics in the field and train teachers to teach the course at the college, while GTUC would house the classrooms, hardware and teaching personnel for the implementation of the course.

The college will also absorb the class into its official curriculum where students who earn qualifying marks in the course will gain employment with RDS.
The President of GTUC, Dr Osei K. Darkwa, said the government had identified Information Technology Enabled Service (ITES) and the BPO industry as one of the key industries for the creation of jobs and the provision of marketable skills for the youth for the country to position itself as a destination of choice for outsourcing."


Ghana Voices defined the BPO industry as:

An information technology enabled service industry in which clients from other parts of the world subcontract services of which they have low competitive advantage over to local firms who have high competitive advantage in that area.

Ghana Voices also discussed the sector's potential to benefit the country, stating that:

It is estimated that the sector could provide over 37,000 jobs for the youth by 2011 in Ghana, with an added value to the country's economy of over 750 million dollars.

Bpoevents reported Dr Darkwa's hopes for students' skills development:

Dr. Darkwa expressed the hope that, the collaboration with RDS would equip the students in the areas like communication skills, computer skills, telemarketing, listening skills, accent neutralisation and keyboard skills which are required to succeed in the industry. Supporting this hope, Mr A. J. Whitman, RDS's Public Relations Manager, said that this partnership was part of RDS's campaign to bring more jobs to Ghana.

Daikieusown quoted Mr Whitman as saying:

We are proud of this partnership with GTUC, in large part because both parties recognize that the private sector cannot grow without the education sector, and vice versa. While still fledging in Ghana, RDS is banking on their ability to drive the sector by strategic partnerships, allowing skills development based on knowledge sharing that benefits all stakeholders, most importantly students.

The BPO industry has been a significant economic driver of countries such as India, Malaysia, and the Philippines, which had been responsible for the creation of tens of thousands of jobs.

Even Vodaphone, noted Eddie Turkson, commented on the agreement:

The Head of Corporate Communication, Vodaphone, Mr Albert Don-Chebe, gave assurance that Vodaphone was strongly behind the deal and commended RDS for having the courage to invest in Ghana, despite the challenges.

During the ceremony, Dr Darkwa mentioned that the challenges facing the industry were the "shortage of manpower which was restricting its growth", as reported by Ghana Voices, and that:

It was to reverse this trend that the GTUC signed the MOU with the RDS to develop a talent pipeline in the short and long term, which would ensure continuous supply of trained manpower to feed the industry.
His colleague, Dr. Robert Baffour, The Vice President of GTUC, further stressed that GTUC would continue to develop all necessary platforms and build the requisite foundation to place Ghana on the technology map

 Daikieusown quoted Dr Baffour:

GTUC has been the leader in ICT activities in the country and would continue to lead and chart the way forward for our country.""

Michael Jackson's Will Released, but Who Wrote It?

Last week, I wrote about some of the potential medical malpractice issues that Michael Jackson's death might raise. This week, the legal issues associated with Jackson's recently released will are driving the discussion.

The New York Times summarizes the provisions of Jackson's five-page will, dated July 7, 2002. The document gives the estate to the Michael Jackson Family Trust Fund and names his mother, Katherine Jackson, as legal guardian of his children, with Diana Ross serving as backup if Jackson's mother predeceased him.

Though Jackson provided for his children, he also stated that he “intentionally omitted to provide for” Deborah Jean Rowe Jackson, the mother of his two oldest children. The will also granted John Branca, an entertainment lawyer, and John McClain, a music executive and longtime friend, full power over Jackson's financial matters.

Otherwise, as Sharon Nelson of Ride the Lightning cautions, you might find yourself the subject of a $2 million lawsuit like the lawyers at Chattanooga, Tenn., firm Berke, Berke & Berke (a firm name that has nothing to do with this guy).

According to Chattanoogan.com, Farrell Hayes is suing the Berke firm (and the individual name partners) for $2 million in a Tennessee circuit court for alleged use of e-mail spyware. Hayes claims that his soon-to-be ex-wife installed eBlaster software on his computer in order to intercept his communications. Applicant Denied Bar Admission for Too Much Debt

Seems that University of California Hastings College of Law graduate Robert Bowman is in a bit of a catch-22, courtesy of the New York State bar. As The New York Times reports, Bowman owes roughly $400,000 in student loans. But Bowman doesn't stand a chance of ever repaying those loans now that he's been denied admission to the New York bar, because five appellate judges viewed Bowman's hefty debt and inability to repay it as evidence of a "lack of general character and fitness requisite for an attorney."

To be fair, the judges were more concerned with the fact that Bowman hadn't made any payments on his debt since 2000, when he graduated law school, rather than the size of the amount owed. But Bowman has had a difficult time along the way. He paid for college (he needed 10 years to graduate, for medical reasons), law school and a masters of law program in London through loans -- 32 in all. He then took the bar four times before he managed to pass. In the meantime, he experienced medical problems and duly sought deferrals from his lenders, who either failed to record his requests or improperly denied them.

For jurors in Michigan, no tweeting (or texting, or Googling) allowed

The Michigan Supreme Court has laid the hammer down on gadget-happy jurors in banning all electronic communications by jurors during trial, including tweets on Twitter, text messages and Google searches. The ruling, which takes effect Sept. 1, will require Michigan judges for the first time to instruct jurors not to use any handheld device, such as iPhones or Blackberrys, while in the jury box or during deliberations.

Law school pays students to stay away

The unstable economy created a tricky situation for law school admissions offices this year. The University of Miami School of Law underestimated the percentage of accepted students who enroll — and is offering incentives for students to sit out a year. Those who opt to delay until the fall of 2010 will receive a $5,000 scholarship when they complete 120 hours of public service and will have a better chance at receiving a $75,000 scholarship, among other incentives.

9th Circuit: Web ad blockers have broad shield from suits

Roberts Jr., who emerged as a canny strategist, thanks in part to the swing vote of Justice Anthony M. Kennedy swinging to the right when it mattered. In the Washington Post, Robert Barnes calls the just-concluded term "the year of living on the verge, one that avoided blockbuster decisions but continued the court's steady move to the right. In the Wall Street Journal, Jess Bravin says the term's most important case may be the campaign-finance case the court decided not to decide, at least not this term.

But in The National Law Journal, Marcia Coyle focuses on a less-heralded aspect of the term -- a "stunning 0-for-5 outcome" for environmentalists. AmlawPB100shd_275 Fears that a down economy would mean a downturn in pro bono work by the nation's largest law firms appear to be unfounded. To the contrary, the annual Pro Bono Report from The American Lawyer finds that the nation's 200 highest grossing firms devoted more hours to pro bono this year than ever before. Nearly half the lawyers at these firms committed at least 20 hours to pro bono and, on average, these lawyers spent more than 60 hours on pro bono matters.

History would suggest this uptick in pro bono is an anomaly. American Lawyer reporter David Bario writes that in past periods of economic upheaval -- both in recessions and booms -- firms have cut back on pro bono. JohnLennonpeace Yoko Ono has won her legal fight to claim ownership of 10 hours of rare, black-and-white footage of John Lennon videotaped at the couple's London estate in 1970. In federal court in Boston, U.S. District Judge Rya W. Zobel has ruled that Ono was the rightful copyright owner of the footage.

I could not find a copy of Judge Zobel's ruling on the court's Web site, but based on reports from the Associated Press and The Boston Globe, the yearlong copyright fight was initiated by a Lawrence, Mass., company, World Wide Video LLC, which claimed it bought the copyright to the video in 2000 from Anthony Cox, Ono's husband before she married Lennon. West, Lexis Offer Help for Hard Times

Two major legal publishers announced initiatives this week to help laid-off lawyers keep their heads above water and make the transition to new jobs. Coincidentally or not, both West and LexisNexis announced their initiatives on the same day.

 West's initiative is a two-pronged effort built around two new Web sites. The first prong is Between Cases, a new site intended to serve as an online resource for displaced legal associates seeking employment and networking opportunities. The site includes job search tools, legal education offerings from West LegalEdCenter, information and resources for setting up a private practice, and special offers from Westlaw and other West services.

Between Cases also offers free resources for displaced attorneys who want to use their transitional time to perform pro bono work. To that end, the second prong of West's initiative is something it calls Do Justice. In cooperation with the Pro Bono Institute, West is contributing over $12 million in free Westlaw access to law firms to support pro bono work they do. China Suspends 1,000 Lawyers

When I posted about the disbarment threats to lawyers in Beijing, only 20 faced a risk of losing their livelihoods. Turns out that the situation is far worse, with the Beijing Administration of Judicial Lawyers suspending the licenses of over 1,000 lawyers and 90 law firms for failing to pass a newly concocted registration exam, reports New York-based New Tang Dynasty Television.

According to the article, Shanghai human rights lawyer Ma Tianlin believes the suspension of licenses is retaliation by the Beijing Justice Bureau over the fact that many Beijing lawyers have demanded direct election of members to the Beijing Bar Association. Some of the lawyers have appealed to the bureau and the bar association, and have tried to negotiate with officials about the cancellation and suspension of lawyers' licenses.

Virtual Law Firms Going Viral

Nearly a year ago, I posted here about the launch of Virtual Law Partners, an 18-member corporate and transactional virtual firm of "elite" lawyers. Though some observers expressed doubt about the viability of the VLP model, today the firm has nearly 40 lawyers.

But VLP isn't alone -- more and more virtual firms are cropping up. As the National Post blog describes, there's the Rimon Law Group and Atlanta-based FSB Group. Both of these are virtual firms comprised of lawyers with at least 10 years of large firm experience; like VLP, Rimon focuses largely on transactional and corporate work, while the 50 attorney FSB Group handles a wide range of practice areas.

In addition to these large virtual firm models that serve corporate clients, there are also smaller virtual practices geared toward individuals or small entrepreneurs. Larry Bodine has a post today about Natoli-Lapin, a two-man virtual shop founded in 2008 that is building a niche in low-cost legal services for entrepreneurs, artists and others launching new business ventures. And Stephanie Kimbro's Virtual Law Practice blog lists a dozen solo and small firms operating virtually, including Kimbro herself in North Carolina. The ABA's GP Solo magazine documents the solo/small firm trend to create virtual practices, with this article by Aviva Cuyler and Niki Black.

Michael Jackson's death could potentially raise medical malpractice and criminal liability issues, writes Eric Turkewitz at the New York Personal Injury Attorney Blog. With speculation that prescription medications may have contributed to Jackson's death, Turkewitz explores some of the issues implicated.

First among the questions that will likely be explored is whether the medications were all provided by a single doctor. If so, Turkewitz predicts that the doctor could be exposed to criminal prosecution (though unlikely), revocation of his medical license or a civil suit. If more than one doctor was involved, a lawsuit would need to examine whether the doctors knew about each other and the medications they were prescribing. Other potential lawsuit targets include the pharmacists who prescribed the drugs, though they may have immunity for following doctors' orders.

Supreme Court Upholds Voting Rights Act

By an 8-1 ruling in Northwest Austin Munic. Util. Dist. v. Holder, the Supreme Court today declined to address the constitutionality of Section 5 of the Voting Rights Act, keeping the law alive for a future challenge, reports Tony Mauro at The National Law Journal. For those who haven't followed the case, Section 5 of the Voting Rights Act requires a number of states and local governments, mostly in the South, to seek federal permission before changing their voting procedures, explains The New York Times. Although the majority decision, written by Chief Justice Roberts, identified the statute's many constitutional infirmities, the Court chose the path of "constitutional avoidance." The Court sidestepped the constitutional question because of the existence of an alternative resolution, in this case, the Texas utility district's ability to try and convince a three judge panel that it was exempt from Section 5.

Amid Controversy, DePaul Names Interim Dean

The latest news to come out of DePaul University College of Law is that it has named a new dean, Illinois Appellate Court Judge Warren D. Wolfson. But that merely begs the question: What happened to the former dean, Glen Weissenberger?

It is a question many students, faculty, alumni and bloggers are asking in the wake of Weissenberger's hasty dismissal last week by University Provost Helmut Epp. Supporters have launched a petition drive for his reinstatement and started a Facebook group in his support. The Chicago Tribune reports that within three hours of the petition's posting, more than 200 faculty, students and and alumni had signed it.

Law Firms Need to Keep an Eye on Lawyers Performing Pro Bono Work

Where a law firm allows an associate to handle a matter pro bono through a legal aid organization, does the firm retain an obligation to supervise the associate? Yes, said Acting Supreme Court Justice Ellen Gesmer in a domestic relations dispute where advice provided to a pro bono client by a Skadden staff attorney was so rife with errors that it justified voiding the ensuing settlement stipulation. The New York Law Journal covers the story.

Lisa Poursine, a staff attorney for Skadden volunteered through the firm's pro bono program to handle a case for inMotion, a non-profit legal group that assists low-income women in matrimonial, family and immigration law cases. Poursine inaccurately advised the client that she her divorce would go smoothly if the client signed a settlement agreement which made it more difficult for the client to relocate to another state as she hoped. Even worse, the settlement agreement forced the client to waive her rights to future claims for equitable distribution. The Poursine explained to the client that without the settlement agreement, the case would be constested and that Poursine lacked the experience or resources to handle a contested matter. 

The client sought to vacate the settlement agreement, testifying that Poursine never explained the equitable distribution waiver provisions or that the settlement would make it more difficult for the client to relocate. The Judge found that Poursine's advice was inaccurate and confusing, and resulted from lack of "appropriate training and supervision." Accordingly, she vacated the settlement.

Skadden says that it accords the same standard of care to pro bono clients as paying clients and now has an adequate system in place to assure that lawyers handling pro bono matters are properly supervised. Even so, this case is likely to make law firms with displaced associates think twice about dispatching them to legal aid organizations if the firm must retain a supervisory role.

GAO: Coast Guard Judges Fair to Mariners

Exval The U.S. General Accounting Office this week released the findings of its review of the U.S. Coast Guard's administrative law judge program. The GAO concludes that the ALJs are able to decide cases independently and free of undue influence from Coast Guard officials. It further finds that the ALJ program contains adequate protections to ensure the fairness of the process for mariners, such as the right to a hearing and to be represented.

The Coast Guard's ALJ program came under attack in 2007, when news reports and hearings before a U.S. House subcommittee raised concerns about whether the ALJs were able to decide cases independently. In response to those concerns, Congress asked the GAO to review the program. Two of the key issues Congress asked the GAO to look into were whether the ALJs have "decisional independence" and to what extent the ALJ program provides protections for mariners.

The mariners involved in these cases are merchant mariners working on commercial vessels at sea. To be employed as a merchant mariner, Coast Guard-issued credentials are required. If the Coast Guard believes that a mariner has failed to adhere to requirements for safety and security at sea, it initiates proceedings to suspect the mariner's credential. (Need an example? Think Exxon Valdez, the largest oil spill in U.S. history, where the skipper was found to have consumed alcohol and left the bridge.) If the mariner denies the charges, the matter goes to a hearing before an ALJ, where the Coast Guard has the burden of proving the charge.

The GAO found that the system "contains elements designed to foster the decisional independence of its judges." In particular, the GAO noted that all personnel actions involving ALJs must be conducted in accordance with independent Office of Personnel Management regulations and that personnel actions against an ALJ may be taken only through an independent agency, the Merit Systems Protection Board.

The GAO also concluded that the system contains adequate protections for mariners. In addition to providing mariners the right to a hearing and to be represented, the GAO found, the Coast Guard follows procedures designed to give mariners fair notice of the charges against them and the ALJs were following procedures regarding the elements to be addressed in their decisions.

Not surprisingly, few of these cases ever make it to a hearing before an ALJ. Of the 1,675 cases the GAO studied, only 3 percent resulted in an ALJ's issuance of a decision and order. The bulk of the cases, 62 percent, were resolved with settlement agreements.

Biglaw Continues Its Slow Creep Towards Blogs

The number of AmLaw 200 law firms with blogs more than doubled since 2007, but they still make up less than half of the nation's largest firms. This week, LexBlog released its periodic State of the AmLaw Blogosphere report. It found that 82 of these firms now have blogs. That is an increase of 110 percent over the first report in 2007, when 39 firms had blogs. In the last six months, the number of AmLaw 200 blogs has risen just 15 percent.

Interestingly, those 82 biglaw firms are responsible for 227 blogs, showing that at least some of them have multiple blogs. Of those 227, 186 are firm branded, meaning that the blog is somehow identified as a product of the firm. The "non-branded" blogs are written by individuals who work at these firms but write the blogs on their own.

Not all these biglaw blogs are active. LexBlog describes a blog from Morris Manning & Martin that deals with the law surrounding open source software as dormant. To me, it appears dead. The link for the blog leads to an Italian-language blog about online gambling. This might suggest that even as some large law firms take small steps towards blogging, others are stepping away.

1.92 Million Reasons Not to Download Music

Stunned. That is my reaction to the news that a Minnesota jury has ordered a 32-year-old woman to pay $1.92 million to the music industry for downloading music. That is $80,000 per song for each of the 24 songs she is said to have downloaded.

The woman's reaction: "Good luck trying to get it from me. ... It's like squeezing blood from a turnip."

This was the second trial for the woman, Jammie Thomas-Rasset, in the first downloading case to go to trial. Two years ago, a jury ordered Thomas-Rasset to pay $222,000 for downloading the songs -- $9,250 per song. The judge declared a mistrial and Thomas-Rasset opted for a second go-around.

The woman's lawyer, Kiwi Camara, told reporters that when he first heard the verdict, he was "angry about it." He had felt confident that any liability finding would be for the statutory minimum amount of $750 per song.

There remains the possibility that the parties will still reach a settlement. A spokesperson for the music industry said after the verdict, "Since day one we have been willing to settle this case ... and we remain willing to do so." The music industry has made its point with this verdict and has nothing further to gain by chasing after money it will never recover. As for Thomas-Rasset, she should be looking for a way to put this nightmare behind her. Let's hope both sides find a reasonable way to bring this case to an end.

The Right Kind of Health Care Reform

We are facing some of the most sweeping changes health care has seen in decades. Reform is needed, but increasing government control over one-sixth of the economy and over important personal and private decisions would harm American taxpayers, health care providers and patients. Cato just launched a new Web site, Healthcare.Cato.org, which provides in-depth analyses of health care issues and reform initiatives that increase consumer choice and energize competition.

President Obama's proposals will inexorably lead to a government takeover of the system.  According to health care expert Michael D. Tanner, this "reform" effort will give government greater control over more and more of our health care decisions. The plan will compel Americans to purchase health insurance, control its content and determine whether Americans receive certain medical services.

According to Tanner, the plan "would not initially create a government-run, single-payer system such as in Canada or Britain. Private insurance would still exist, at least for a time, but it would be reduced to little more than a public utility, operating much like, for example, the electric company, with the government regulating and controlling every aspect of its operation."

What will it cost taxpayers?

Tanner explains, "Obamacare will be expensive. The Congressional Budget Office's initial scoring of Ted Kennedy's health-care bill shows it would cost at least $1 trillion over the next ten years."

The CBO study also found that the plan would result in roughly 23 million people losing the insurance they currently have. The actuarial firm Lewin Associates estimates as many as 118.5 million would shift from private to public coverage, resulting in a nearly 60 percent reduction in the number of Americans with private insurance.

There are market-based solutions to the problems besetting the current health care system. In a Policy Analysis, John H. Cochrane explains how "free markets can solve this problem, and provide life-long, portable health security, while enhancing consumer choice and competition."

The key, he says, is "Health-status insurance." He writes:

If you are diagnosed with a long-term, expensive condition, a health-status insurance policy will give you the resources to pay higher medical insurance premiums. Health-status insurance covers the risk of premium reclassification, just as medical insurance covers the risk of medical expenses.

With health-status insurance, you can always obtain medical insurance, no matter how sick you get, with no change in out-of-pocket costs. With health-status insurance, medical insurers would be allowed to charge sick people more than healthy people, and to compete intensely for all customers. People would have complete freedom to change jobs, move, or change medical insurers. Rigorous competition would allow us to obtain better medical care at lower cost.

Cato health policy analyst Michael F. Cannon says that one way to fix the health care system is to make consumers care about cost:

More than 200 million Americans have public or employer-controlled coverage, and all are essentially purchasing it with someone else's money. And that's the problem: Americans demand more coverage than they would if they were spending their own money. In fact, we demand as much coverage as Canadians, for whom health care is supposed to be free. Both American and Canadian patients pay only about 14 cents for every dollar of medical care they consume.

…If we want to increase access to health care, our first priority must be to contain costs. Nothing would help more than 200 million cost-conscious consumers.

Letting Americans own their health care dollars is the right thing to do. And as it happens, it would also cover a lot of the uninsured.
