LAWYERSCHILE: Anti-Law School Blogs Seek to Keep Others from Making 'Same Mistake We Did'

Anti-Law School Blogs Seek to Keep Others from Making 'Same Mistake We Did'

It has taken me a while to realize the scope of this, but I now see that there is a good-sized army of young lawyers who have taken to the blogosphere with a common mission: to alert any wannabe lawyers out there to the futility of such a decision. As the Big Debt, Small Law blog puts it, it is the beginning of a "quiet rebellion:"

We prefer not be crammed elbow to elbow in document review gulags for less money than an ex-con gets paid to stamp holes in sheet metal. We prefer not to run around toilet courts and haggle over $500 whiplash cases for 45 K a year and no health benefits. Our sole purpose is to dissuade, deter and prevent more hapless lemmings from repeating the mistake of law school. Law has no rewards. Instead of pots of gold, you'll find only piles of sh*t.

BDSL is hardly alone in this... [MORE]

LAWYERSCHILE: Intrastate Fights Over Healthcare Legal Challenge

Intrastate Fights Over Healthcare Legal Challenge

OCARE The blawgs have, obviously, been chock full o' stories on the passage of the health care bill and the lawsuits challenging its constitutionality that began rolling in literally within minutes of the President's signing it into law. Here's a link to the WSJ Law Blog post on the suit by several state attorneys general, as just an example.

But there hasn't been a lot of focus on the internal political rifts that seem to be muddying the waters in at least a couple of states as to whether they wish to participate in the challenge. In Nevada... [MORE]

'Global Pulse 2010: An online invitation to talk to decision makers'

'Global Pulse 2010: An online invitation to talk to decision makers'
by Lester Bolicenni

From March 29 to 31, Global Pulse 2010 aims to gather over 20.000 individuals and representatives of organisations in an online conversation dealing with topics ranging from human development to science and technologies.

The event is sponsored by US Agency for International Development (USAID), and the goal is to give world citizens an opportunity to voice opinions and share ideas for innovative solutions to social issues. According to USAID, the inspiration for the online event is a speech President Barack Obama gave in Cairo in June 2009 in which he said he would promote partnership with the rest of the world.

Ten topics of discussion

The event will last 72 hours non-stop, and participants will be able to follow and comment in several live discussions simultaneously. All discussions will be led by featured opinion leaders, decision makers and NGO members, including Youssou N'Dour [fr], famous Senegalese singer, deeply engaged in the fight against malaria, Iqbal Z. Quadir, founder of Grameenphone in Bangladesh, and even Ethan Zuckerman, co-founder of Global Voices Online.

Participants from at least 128 countries will share and discuss on ten broad topics, listed here :

Inspiring a new generation
Empowering Women and Girls
Enabling the Essential Education
Building Stronger Partnerships
Exercising Political and Civil Rights
Promoting Global Health
Advancing Entrepreneurship, Trade & Economic Opportunity
Fostering Science, Technology & Innovation
Supporting a Sustainable Planet
Pursuing Grand Challenges

Innovative technology

Gathering thousands of people online at the same time could be tricky. Fortunately, the forum technology that will be used, IBM Jam, has been already been tested in previous events.

Bill Tipton took part in Habitat Jam - a three-day online event in 2005 to solicit ideas on urban sustainability. In a blog at the Global Dialogue Center he  shares his experience:

I know this can work from participating in such an event in 2005 [...] Tens of thousands of individuals – including government and business leaders, NGOs and specialists — came together to discuss real issues and concerns facing  the world's urban communities.

[...]

I still meet and work with people I met in that truly remarkable Jam and  expect to meet other extraordinary individuals in Global Pulse in 2010.

Participating

To  join the Global Pulse event, you only need a computer and internet access - and you also have to register in advance (for free). Before March 29, you can follow @globalpulse2010 on Twitter as well as the hashtag #gp2010. There is also a Facebook page with almost 700 fans, where suggestions have already been posted.

One idea by Oliver Mupila goes:

Query: Can Global Pulse suggest effective indicators for tracking the progress of grand corruption cases from referral to the investigating agencies, through to the Director of Prosecutions, onward to the courts and  progress while they are in court without compromising the individuals right to a fair trial/hearing or reputation before they are convicted? What is considered good practice in this area and are there any countries that do this particularly well? And why are news writers in Africa not in good books [of] the government?

According to Dr. Rajiv Shah, Adminsitrator of USAID, the online summit will gather "individuals who are not normally seated at the table with key  decision makers". Could this be a move towards the future of democracy? It should at least be interesting to find out.

Video: Carolyn Elefant on the Impact of Blogs on Solo and Small Firm Lawyers

Video: Carolyn Elefant on the Impact of Blogs on Solo and Small Firm Lawyers

Back in December, I helped mark the 7th birthday of the My Shingle blog with this video interview of its founder (and Legal Blog Watch alumna), Carolyn Elefant. In it, Carolyn reflected on her relatively long tenure in the legal blogosphere and the many things she has learned along the way.

This week, Carolyn published this post with a video from a related presentation she delivered in December as part of Northwestern Law's Fourth Annual Judicial Symposium on Civil Justice Issues, where she appeared alongside bloggers Mark Herrmann and Eugene Volokh.

Carolyn's remarks in the video focus on the impact blogging has had in the world of solo and small firm practitioners, an area that she says was under the radar of most legal media when she started out. She comments on some of the trends she's seeing in this area, and the role that blogging can play in improving the quality of legal services that solo and small firm lawyers provide to clients. Check out the video below: [MORE]

LAWYERSCHILE: Enter the U.S. Supreme Court Tweet Contest

Enter the U.S. Supreme Court Tweet Contest

Via this post on Bob Ambrogi's LawSites, I discovered a creative contest being organized and promoted here by Daniel A. Schwartz's Connecticut Employment Law Blog. The challenge? "Summarize, comment on, or write something pithy" on any Supreme Court case in a single "tweet" on Twitter.

Schwartz offers a couple of examples:

* Brown v. Bd of Ed: Remember Plessy v. Ferguson? We don't know what we were thinking. Yes, separate schools are inherently unequal #cbftech

* What would Law & Order be without its most common phrase "You Have the Right to Remain Silent"? Thank you Miranda v. AZ #cbftech

Schwartz says the best Supreme Court-themed tweet will receive a modest prize of some kind, and that many of the top entries will be shared at the upcoming Connecticut Bar Foundation's Technology Symposium.

Here are the basic instructions to participate: [MORE]

LAWYERS CHILE: Octogenarian Sisters Square Off Over Question Ripe for Contracts 101

Octogenarian Sisters Square Off Over Question Ripe for Contracts 101

Powerball I've been keeping an eye on the Law and Magic blog (because, well, it's a blog about law and magic!), and learned in this post about the crazy story of two octogenarian sisters from Connecticut who squared off against each other yesterday in New Britain Superior Court. Here are the facts as reported by the Associated Press, which will surely appear as a question in a law school Contracts 101 exam sometime soon.

Rose Bakaysa and her younger sister Theresa Sokaitis were two of nine siblings, and had always shared a special bond. As they hit their 70s and 80s, a big part of their connection centered around their dream of "jackpot riches." They shared lottery ticket purchases and went to casinos together. For years, however, lady luck avoided these gals.

Then, in 1995, Sokaitis won $165,000 playing poker at Foxwoods casino while her sister was on the slots nearby. Sokaitis testified this week that she intended to split it evenly with Bakaysa and ultimately gave her about $64,000. This big haul led the sisters to draft a written, notarized contract in which they agreed to split all future winnings equally between them.

Nine years later... [MORE]

LAWYERSCHILE: 9th Circuit (Eventually) Rules Inmate's Hands Not a Dangerous Weapon

9th Circuit (Eventually) Rules Inmate's Hands Not a Dangerous Weapon

Scissorhands One great thing about having the dual advantages of lifetime tenure and a cadre of clerks at your command is that you can feel free to wax poetic -- or rhapsodic, depending upon your nature -- about things that the man on the street wouldn't spend a lot of time debating.

Lowering the Bar, with its usual flair, brings us a recent example from the 9th Circuit. In United States v. Rocha (PDF), the court reversed a federal inmate's conviction for assault with a dangerous weapon. Because it was undisputed that he used nothing but his bare hands in the attack at issue.

Sounds like the right decision. So how could the court have taken nine pages to get from point A to point B? As follows: [MORE]

Ann Coulter Gets a Preemptive Lesson in Canadian 'Freedom of Speech'

COulter Love her or hate her, you can't deny that Ann Coulter, cable news show darling and Weekly Hot Conservative for September 12, 2009, has a talent for getting attention.

Some of that attention this week has come from north of the border. In advance of a mini-Canadian tour of speaking engagements, Coulter received an e-mail from the provost of the University of Ottawa. Francois Houle said he was pleased as punch to have Coulter come and speak today at the invitation of the school's campus conservative organization, as long as she didn't say anything that might be construed as "promoting hatred against any identifiable group."

RSE: Social Responsibility

Social Responsibility

Printable page

ISO, the International Organization for Standardization, has decided to launch the development of an International Standard providing guidelines for social responsibility (SR).

The guidance standard will be published in 2010 as ISO 26000 and be voluntary to use. It will not include requirements and will thus not be a certification standard.

There is a range of many different opinions as to the right approach ranging from strict legislation at one end to complete freedom at the other. We are looking for a golden middle way that promotes respect and responsibility based on known reference documents without stifling creativity and development.

Our work will aim to encourage voluntary commitment to social responsibility and will lead to common guidance on concepts, definitions and methods of evaluation.

The need for organizations in both public and private sectors to behave in a socially responsible way is becoming a generalized requirement of society. It is shared by the stakeholder groups that are participating in the WG SR to develop ISO 26000: industry, government, labour, consumers, nongovernmental organizations and others, in addition to geographical and gender-based balance.

ISO has chosen SIS, Swedish Standards Institute and ABNT, Brazilian Association of Technical Standards to provide the joint leadership of the ISO Working Group on Social Responsibility (WG SR). The WG SR has been given the task of drafting an International Standard for social responsibility that will be published in 2010 as ISO 26000.

We invite you to come and learn more about SR.

We also welcome you to support the ISO SR Trust Fund.

Internet enemies" report raises controversy in Russia'

Internet enemies" report raises controversy in Russia'
by Gregory Asmolov

The degree of freedom in the Russian Internet is an issue for debates. Sometimes we might hear that in a discussion of the Internet Freedom Russia is be named in the same list with the "problematic countries" as China and Iran. Others, strongly oppose this kind of generalization, and claim that Russian Internet is the most liberal and unrestricted public sphere in Russia

The recent "Internet enemies" report [ENG] by "Reporters without Borders" tried to make order in regard to placement of Russia on the Internet of freedom scale. It placed Russia in the list of "Countries under surveillance". This placement and especially the justification for it by the report's authors raised discussion and disagreement in Russia.

The report states [ENG]:
After the takeover by the Kremlin of the audiovisual media early in the Putin era, the Internet became the freest space for discussion and information-sharing in Russia. Yet its dependence is threatened by blogger arrests and prosecutions, and the blocking of independent websites labeled as "extremist." The Web has also become a first-rate sphere of activity for government propaganda and could become a political control mechanism.
The reports names a long list of government affiliated activities that should be considered as limitation of Internet freedom. Among these facts and activities web surveillance system  "SORM-2", that makes possible to monitor online content for security agencies, the fact that some of major social media platforms were bought out by oligarchs with close ties to the government, the story of blocking oppositional websites by WIMAX Internet provider Yota, cyber attacks against liberal websites and persecutions against bloggers.

There are some more optimist statements. The report suggests that "The Internet has become a space in which people can denounce the corruption of Russian officials" . However, it concludes that despite this fact "the impact of these online mobilizations, blogs and new media on Russian society is still relatively limited" and warns that censorship in Runet might increase.

Radio "Liberty" website asked for opinion about Russian chapter of the "Internet enemies" report from few Russian experts. A famous blogger and journalist Oleg Kozyrev said [RUS] to Svoboda:
Мы живем в ситуации, когда любой блогер может стать участником уголовного дела. Но тотального преследования блогеров, конечно, сейчас в России нет. Есть просто эпизодические удары по некоторым гражданским активистам. Я бы разделил ситуацию с блогерами на два типа: собственно преследование государства - силами правоохранительных структур, провластных политических организаций. И когда блоггер подпадает под административные или уголовные правонарушения из-за того, что законодательство его надежно не защитило.
We live in reality, when every blogger might be a matter for criminal case. But, certainly, there is no total persecution of bloggers in Russia. There are episodic attacks on some of civil society activists. I would distinguish between two types of situations. First, persecution be government, the law enforcement of political forces that affiliated with government. Second, when blogger find himself under administrative or criminal persecution, since the law is not good enough to defend him.
`The executive director of "Social networks" agency Denis Terehov opposes [RUS] the idea of censorship in Runet:
О какой цензуре можно вести речь, если на сегодняшний день в Рунете есть 60 млн. аккаунтов сети в "Контакте", 50 млн. аккаунтов в "Одноклассниках" и 2 млн. дневников в "Лайф Джорнале". Кто кого контролирует? Кто кому не дает писать? Мы же не в Китае, где цензурируют "Гугл". Мы же не в Казахстане, где отключили "Лайф Джорнал". Никто никому не запрещает писать, объяснять свою позицию.
About what kind of censorship we can talk, if today in Runet we have 60 million accounts in "Vkontakte", 50 million accounts in "Odnoklasniki" and 2 million blogs in Livejournal. Who controls it? Who prevents to write anything from whom? We are not in China, where "Google" is censored. We are not in Kazahstan, where access to "Livejournal" is blocked. No one don't prohibit for anyone to share his opinion.
A head of "Freedom of Speech Protection Foundation" Aleksey Simonov, emphasizes [RUS] the difference between Russian traditional media as a space of self-censorship where editors and journalist know in advance what they not allowed to say, and the Internet:
Что касается Интернета, то там цензуры не может быть. Цензура - это предварительный просмотр перед публикацией. Но ведь невозможно предварительно посмотреть, например, блог, верно? Вопрос не в том, чтобы не дать этому выйти, а в том, чтобы наказать за то, что уже вышло. А это уже называется по-другому.
In regard to Internet, censorship can't work there. Censorship is a check before the publication. But you can't check a blog before it was published. The question is not about publication prevention, but the punishment that might come after the publication. And it has another name.
However, beyond the discussion if the Russian Internet is censored or not, the way that this claim was explained by the "Internet Enemies" report raised some debates and discussion.  Alexander Amzin, Internet expert for major Russian online news agency Lenta.ru wrote an article, which argued with most of facts that were included in the Russian chapter of the "Reporters without Borders" report.

Amzin writes [RUS]
These six pages is the most amazing collection of myths and legends about Runet, for last few years.
According to Amzin, some of the facts in the report are old news. For instance, SORM-2 system works since 2000 and there are no clear evidences that it caused any repressive actions. Moreover, Amzin reminds that most of countries have some systems for traffic monitoring. Other old news is purchasing of the Livejournal platform by Russian oligarch, who has some ties with Kremlin. There also no clear evidences that it had any impact on freedom of expression in Livejournal.

Amzin also reminds that the blocking of websites by Yota provider included governmental websites. He reminds that further development of this incident showed that this block was not censorship but a technical problem. The Lenta.ru expert points out that Vadim Charushev  who was confined against his will in a psychiatric hospital wasn't creator of Vkontakte social networks, as the report claims, but a social networking activist. Amzin also disagree with a claim that Russian law authorized the government to intercept Web data without a prior court order.

The most outrage of Amzin was raised by reports claim about a group called the "Brigade," that includes people who leave pro-government comments, while some of them doing it for money.
Unfortunately, no one explained to experts from "Reporters without borders" that brigade is an urban legend of Runet. People says, that every popular blogger has a curator in security organizations. People say, that every patriot get salary. People say, that government organize DDoS attacks against oppositional websites. It all rumors from the same box. To approach it in a critical way you can just use the Hanlon's Razor («Never attribute to malice that which can be adequately explained by stupidity» ).
Amzin also says that the claim that online mobilization is limited in Runet ignores the reality. However, there is one point the Russian expert agrees and gives compliments to the report:
Может создаться впечатление, что отчет состоит из одних ошибок. Это не так. Серьезная часть документа занимает ровно одну страницу. Там перечислены блогеры, которые за свои высказывания понесли уголовную ответственность или просто стали фигурантами уголовных дел. Блогеров действительно сажают, и это действительно очень плохо.
One can get an impression that the report includes only mistake. No. There is a serious part of this document that takes one page. It is a list of bloggers who were a subject for criminal prosecution for their opinion or were questioned within criminal cases. Indeed, bloggers go to jail and it's very bad.
The article by Amzin also raised a discussion among Runet users. Some of them claimed that Amzin himself demonstrates exaggerated patriotism and mentioned very recent stories that raised lack of confidence in Runet zone including shutting down of Torrents.ru and Ifolder.ru websites.  One can also recall the case of Yandex blog rating closure, that removed one of the most powerful platforms for alternative agenda setting in Runet.

One of the comments opposes [RUS] the claim that the "Brigade" is a myth:
Тролли есть. Все сайты где обсуждается наше родное дерьмо валят тупыми однотипными комментами с целью свести обсуждение на банальные оскорбления. И за это начисляется зарплата. И есть кураторы. Автор, Вы не из них? Истеричное выдергивание ошибок списка "врагов интернета" выдается как необъективность всего списка. Автор считает, что "Репортеры без границ" не в состоянии мониторить инфу про Рунет?
There is trolling phenomenon. All the online platforms for discussion of our ugly reality has the same stupid one type comment that aim to lead discussion toward banal insults. And they get salary for it. Ander they have curators. The author, may be you one of them? The hysterical attempt to list the entire mistake from the "Internet enemies" report is portrayed as a proof for lack of objectivity of the whole chapter. Does author believe that "Reporter without borders" are not able to monitor information about Runet?
The controversy around Russian chapter of "Internet enemies" report emphasizes the high degree of complexity of the reality in the Russian segment of the Internet. The questions of government's involvement nature, censorship and limiting freedom of speech have no a simple answer. The Runet have to be under surveillance. Including Russia in the list of countries that should raise concerns is certainly justified. But it also requires careful approach that can distinguish myth form facts, try to investigate the complexity, and avoid "black and white" approach that categorizes some of processes as evidences for repressive actions by government.

Is Faxing Dead? No, Just Different

Is Faxing Dead? No, Just Different

The rollout of the fax machine in the 1980s was revolutionary. Instantly sending pieces of paper through the ether to another person on the other side of the country or the globe? It blew our minds for a while, and then became an indispensable part of every office. (Check out this photo of what is said to be the very first fax machine, used by a post office in Europe in 1979).

But in 2010, has the fax become a relic of the 1980s, like "big hair, Cabbage Patch Kids, and padded shoulders?" (Or, more specific to law offices, like law review subscriptions, typewriters, bike messengers and law libraries?) In a guest post on the Legal Technology Blog, Steve Adams of Protus says that faxing remains a vital part of the business world despite the advent of e-mail.

Adams notes that faxing is still used on a daily basis in many professions: by real estate agents and insurance brokers, for example. The key change in the use of faxes, he says, is that an actual fax machine is fading away as a means of sending and receiving faxes, in favor of Internet fax services. Adams says that Internet fax services can do things a fax machine never could: [MORE]

lawyerschile: Should I Scrap My Law Blog and Start a New One?

Should I Scrap My Law Blog and Start a New One?

Delete Throughout more of the blogosphere than you might expect, a question appears to be percolating: Should I shut down my current blog, make a clean break, and start anew with another? Well-known bloggers such as Bob Ambrogi are asking that question. So is Venkat Balasubramani. And so is Ron Coleman.

Why the urge to purge? Ambrogi says he started his LawSites blog back in 2002 as an adjunct to his book, The Essential Guide to the Best (and Worst) Legal Sites on the Web. As his blogging interests have broadened through the years to things like media law and technology law, however, he feels that "the name LawSites no longer reflects what I want my blog to be."

Similarly, Balasubramani has been blogging at Spam Notes for about 3-and-a-half years on spam-related legal issues. His interests and his law practice have broadened well beyond the spam arena, and he, too, is wrestling with the question of whether to scrap Spam Notes and launch a new blog. In this post Balasubramani lays out in detail some of the pros (branding; chance to move to a better platform; fresh start with no baggage) and cons (loss of "google juice;" loss of subscribers/regular readers during the transition) of scrapping his current blog.

In response... [MORE]

Chile's new government

Chile's new government

Running to rebuild a shaken country

Lacking his predecessor's popular touch, Sebastián Piñera (below) and his team of business technocrats will face pressure from Chileans for quick results

Mar 18th 2010 | SANTIAGO | From The Economist print edition

HE HAS always been hyperkinetic. But taking office as Chile's president just 12 days after a devastating earthquake has thrown Sebastián Piñera into a frenzy of activity. No sooner had he been sworn in on March 11th as the country's first elected right-of-centre leader in half a century than he was off on a helicopter tour of the damage from a big aftershock, cancelling lunch with seven visiting Latin American presidents. Having set up an emergency committee under his interior minister to handle the disaster, Mr Piñera is doing much of the work himself, holding cabinet meetings late into the night and making whistle-stop visits to the worst-affected areas in south-central Chile.

He has a big task ahead of him. The ground is still shaking. Parts of the coast have been raised by two metres. The death toll (at around 500) is lower than at first feared. An official in the outgoing government reckons that 150,000 families were made homeless (down from an initial guess of 500,000). Even so, the new team guesses that the earthquake has caused damage to infrastructure, businesses and homes of some $30 billion (a sum equal to around a fifth of GDP), though it will be weeks before an accurate tally is made.

The damage is concentrated in the regions of Maule, Bío-Bío and O'Higgins, all to the south of Santiago. A string of coastal towns and villages were flattened by a tsunami triggered by the quake. They are thick with the stench of rotting fish, thrown ashore by the waves.

Schools and hospitals were destroyed or damaged. In all, some 250,000 people still lack access to primary health care according to the Pan American Health Organisation. The quake coincided with the start of the school year. Pupils from damaged schools are doubling up in others, or will use temporary classrooms. Mr Piñera has given orders that all classes must resume by April 26th.

Water and electricity were quickly restored in most places. All the main roads were made passable within a few days, although some still have temporary bridges. But some minor roads in coastal areas are still blocked or can be used only by light vehicles. Santiago airport is working again, though passengers must use tents because the main terminal building was badly damaged. So was the big fishing port at Talcahuano, in the south, as well as quays in many smaller fishing towns.

As the southern-hemisphere summer turns to autumn, the priority is shelter. A Catholic charity has begun to build emergency housing for 20,000 families. It is basic: small, uninsulated wooden huts without kitchens or bathrooms. How robust they will prove in the winter storms that typically whip south-central Chile is unclear. And another 40,000 more are needed. One local mayor has refused the huts out of fear that they will become permanent shanty towns—something Chile's governments had all but eliminated over the past 25 years of rising prosperity.

The country is far better placed to rebuild itself than it was after the previous big earthquake in 1985, let alone the one in 1960 which was of similar massive force to that of February 27th. Stricter building standards limited the damage. Insurance will cover around a quarter of the total bill, and is mostly reinsured abroad. Mr Piñera can draw on savings of over $11 billion, piled up in an offshore sovereign fund by his fiscally prudent centre-left predecessor, Michelle Bachelet. The government has almost no debt and an investment-grade credit rating. Ordinary Chileans are better able to help each other too: a telethon held earlier this month for the housing charity raised $59m, twice its target.

Chile's big copper mines, which produce around half its total exports, lie north of the quake zone and were unaffected. But many labour-intensive export industries—forestry, fishing, wine and fruit—were hurt. A strong economic recovery, after last year's recession, has been dented, though investment in reconstruction will boost growth by the end of the year.

All this will be a big test for Mr Piñera, a successful businessman whose political skills are relatively unproven. Ms Bachelet's natural empathy with ordinary Chileans meant that she left office with an approval rating of over 80%, even though her government's immediate response to the earthquake was not faultless.

Chileans will look to Mr Piñera for results. His cabinet is stuffed with technocrats, most of them educated at private schools and Santiago's Catholic University. Many have close ties to Chile's main private business groups. Respect for their technical skills and efficiency could easily turn to resentment in a country that has just become poorer and even more socially unequal. The new president had better keep running.

What Belly Dancing Taught Me

What Belly Dancing Taught Me
about Personal Branding

by Lisa Barone

image of belly dancer

I'm learning to belly dance.

Okay, that's totally overstating it. I'm wiggling to music in what is labeled a belly dancing class.

I've found that I enjoy the constant movement, manipulating my limbs and taking any excuse I can to be silly. But more fun than the belly dancing is the instructor.

She loves this stuff. Her eyes light up when she enters the room, her voice changes pitch, and she hops around throwing out euphemisms that make even the bravest people blush. She's a complete fruit loop. And she's loved for it. It's her schtick.

Or, in marketing terms, it's her personal brand.

Oh no, not another post about personal branding

We've been hearing about personal brands ad nauseum for the past year. Even if you're not sure why you need one, you're certain that you do. It's like a 401k. Or a spouse.

The trouble is, most personal brands make everybody else want to jab forks straight into their eyes. They're based on egos, false promises, and personalities so obnoxious that you'd never be friends with this person in real life.

But as my belly dancing instructor has taught me, you don't have to build a personal brand on being an egomaniac. You can build your brand on simply being human. Or better yet, you can build your brand on being your favorite version of yourself.

How do you create a personal brand that will garner attention instead of hate? Here are some tips I've picked up from my experience on the Web.

And belly dancing.

Claim your niche

My belly dancing instructor doesn't teach the hip hop class that takes place after her session. Nor does she teach the weekend kickboxing class. She's limited herself to belly dancing because she knows that's where she can offer the greatest value.

Trying to teach everything would undermine what she's about and the tribe she's looking to attract. She sticks to what she does better than anyone else.

Think niche. You can't be known for everything. Pick what's most important to what you do, break it down to its simplest core, and be it.

While Copyblogger has established itself as one of the Web's top resources on content, Brian Clark has branded himself the master of headlines. It's a tiny microcosm of the whole content creation space that he owns. It's where he's untouchable.

Create your character

Like I said, my instructor is a fruit loop. The moment you think you've seen everything, she ups the ridiculousness.

She tears her sweats so you can watch her legs curl, and refers to body parts in ways you wish you could erase from your mind. She knows who she needs to be to attract the right audience, and she plays up her quirks to do so. She builds a tribe that falls in love not only with her class, but with her. It becomes so that the class and brand are so intertwined that you can't tell them apart.

Lots of people will tell you to "be yourself" in social media. I'd advise creating a persona that mixes who you are and who you want to be. This heightened version of yourself allows you to lose the performance anxiety and magnify the personality traits needed to attract the right people.

We fall in love with those who are brave enough to do what we think we can't. As long as you're basing your character off who you really are, you'll be able to keep it authentic and still look great naked.

Treat people like humans

My instructor has been dancing for longer than I've been an adult. She's trained in moves and styles that my stiff body can't even comprehend.

But you wouldn't know that by talking to her. She's unassuming and talks to you like you're old friends meeting up for coffee. And she keeps that tone even when instruction has begun. There's no jargon to confuse us, no making things complicated so we feel dumb and she wouldn't dare call herself an "expert" or a "guru." She's just someone who loves belly dancing and is excited about the opportunity to share it with us.

Finding your voice and using it to be relatable is what will make or break your personal brand. It's what separates the brands we love from the brands we wish would die.

It's all about your ability to talk to people in a genuine way and show them that you're one of them. This is where most people get tripped up. We elevate ourselves thinking that it makes us more impressive and authoritative and that our audience will trust us more. Truthfully, all this does is alienate you from the people you're trying to connect with.

Figure out what the real you sounds like, and then use that voice to be real with others. You can't fake this.

Make your brand accessible

My instructor shows up to class early. She stays late. She takes questions in the middle of instruction and will show and re-show certain movements until you've nailed them. Her email address is publicly available so that students can email her with questions. She has an email newsletter to help us stay in contact with not only her, but one another.

She's not teaching a class, she's creating a community.

When you make your brand accessible, you help it grow beyond your niche. Become part of your community. Answer questions. Lift up those who are doing well. Share trusted information. Look for ways to extend your brand through blogging, guest postings [cough], email newsletters, and direct mail.

Everything that you put out should incorporate and promote your personal brand. The more people see you and your tribe, the more they'll gravitate toward it. It's social proof.

Your personal brand is you. It's who you are, what you believe, and what you want to put out there to others.

Use the social tools available to be you as loudly as you can, while always offering a benefit to those around you. Your personal brand may be all about you, but it's also about how you make others feel.

It's emotional DNA, and what separates the personal brands we love from those we love to tear apart.
