Obama Unrated on Lawyer Rating Site

In just a few days, voters will be asked to decide whether to cast their ballots for or against the one lawyer running for president, Barack Obama. But at lawyer-rating site Avvo, the verdict remains out on Obama's score as a lawyer. Obama's Avvo profile shows him as unrated. According to the site, that means "we don't have sufficient information to calculate a rating or because a rating would not be useful." It also shows that Obama has yet to claim his profile, which would allow him to edit and add to it. Wife Michelle, also a lawyer, is likewise unrated on Avvo.

The Obamas' profiles show Barack's sole area of practice to be civil rights and Michelle to be devoted exclusively to intellectual property. According to their profiles, both Barack and Michelle are inactive members of the Illinois bar and neither has been the subject of discipline. Among Barack's honors, according to Avvo, are honorary doctorates of law from five universities, while Michelle's include having been named one of the world's 10 best dressed people by Vanity Fair, one of The Harvard 100 by 02138 Magazine and one of the world's 25 most inspiring women by Essence Magazine.

Note to Obama's campaign staff: Get on this. Claim his profile today and by tomorrow he could be a 10. It could just help on Tuesday. Plus, if the election thing doesn't work out, he'll be all set to hang a shingle.

Lawyers Fall Short in Protecting Client Confidences in a Mobile Age

Lawyers have an ethical obligation to safeguard client confidences, yet most are falling short when it comes to protecting clients' privileged information in a this on-the-go age. The results of a recent survey of U.K. law firms by Credant Technology show that 24 percent of U.K. firms admit to misplacing at least one mobile device containing confidential information. Yet at least two-thirds of the lawyers surveyed continue to use mobile devices -- such as BlackBerrys, laptop computers and USB memory sticks -- to store confidential information.

According to the survey, most lawyers do protect their mobile devices with a password. However, according to Robert Schifreen, an IT security consultant (and former hacker) quoted in this press release:

Passwords are just inadequate if you have confidential sensitive information residing on a mobile device. You can download cracking software from google that can break the average password in less than 30 minutes. These findings show just how naïve the legal profession is when it comes to data security and I suspect other professions are just as bad, if not worse! The only answer is, if you store sensitive data, you must encrypt it.

So what can lawyers do to protect confidential client data?  Credant offers these tips:

-- Encrypt the data on every device you carry if it's sensitive.

-- Get a solution which can detect devices trying to connect to the enterprise and sync up with corporate data.

-- Make sure the encryption solution is transparent to end-users and doesn't interfere with any of your operational activities.

-- IT departments should never leave data security up to the end user.

Where the Jobs Are

Even though firms are laying off attorneys, pockets of opportunity remain for job-seeking lawyers -- they just need to know where to look, and also where not to.

For example, sending résumés blindly isn't likely to produce many results, particularly at this time. Over at The Am Law Daily, BCG Recruiter Dan Binstock is quoted as saying that he's never seen more résumés, and that even partners are beginning to look for other opportunities. At the same time, the Am Law Daily post points out that overseas markets are continuing to hire -- and associates might consider positions in law firm outposts in Asia or Dubai. In addition, there are also opportunities in U.S. markets outside of New York or other cities hit hardest by the bailout. For example, much of the oil-related work originating in the Middle East now winds up in Houston, and thus, the Houston energy and finance legal markets remain strong. There's also the possibility of work arising out of the economic rescue package -- though for now, the newly created Office for Financial Stability that will oversee the bailout doesn't have any plans for hiring lawyers.

And believe it or not, even now some firms continue to hire, says the Wall Street Journal. Firms with strong balance sheets are taking the opportunity to hire lawyers from competitors in areas such as mergers or debt offerings, which can help firms diversify during the downturn and explore new business opportunities. In fact, K&L Gates has been acquiring midsized firms during this period and has plans to grow aggressively during the downturn.

As for lawyers who are still employed, firms are trying to reassure the troops that their jobs are safe, reports a post at the Counsel to Counsel blog. But if associates have been idle for six months, they're well advised to start looking, irrespective of any assurances of work from the firm.

New Am Law Tech Survey Released

Via Ron Friedmann at Prism Legal, I learned that the 2008 Am Law Tech Survey is out, with a detailed summary at Law Firm Inc.  This year, the study revealed that most firm IT directors are grappling with questions like:

-- What emerging technologies are worth investing in -- and which aren't ready for prime time?

-- Should increasingly tech-savvy attorneys be able to download software they find on their own, or should firms vet everything first?

-- Does the new generation of Web 2.0 tools -- blogs, wikis and social networking sites -- have a place in a law firm environment?

-- How can the enormous quantities of data lawyers generate possibly be managed?

As for the trends covered by the study, Ron Friedmann suggests that none are that surprising, and I'm inclined to agree.  Voice Over Internet Protocol (VOIP) continues to attract interest within firms, but still hasn't broken into prime time.  Firms are dabbling in Web 2.0 and social networking (43 percent run one or more blogs; 24 percent use intranet wikis (Web pages that let users contribute or modify content), but these tools haven't reached the same penetration at large law firms as they have at corporations. 

At the same time, firms aren't as focused on Web 2.0 or VOIP right now since most indicated that their major challenge is figuring out how to store and organize data.  Some firms are exploring in-house options while others have, or are considering, outsourced data storage.

Lawyer Couple Travels the World

Here's an interesting story about Shanna Singh Hughey and her husband Derek, two newlywed lawyers who've just returned from a year-long honeymoon traveling the world. Naturally, the pair brought their laptop and documented their adventures at a blog, One Year On Earth. To finance the trip, the couple sold Derek's house in Nashville and traveled frugally. And of course it didn't hurt that Shanna had a position waiting for her at O'Melveny & Myers upon her return. As Shanna herself noted: "Derek is looking for a new job, so knowing one job was waiting at the end of the road was such a gift [...] No jobs would be really difficult."

Yet Another Presidential Election Roundup

PresbadgeI know that I just posted a Presidential Election Roundup just a few days ago, but as election day draws closer, news continues to emerge.  Plus, given the limited focus that's being given to issues in the campaign, it's refreshing to find pieces that actually inform rather than incite.  With that said, here's the latest:

Presidential Election to Impact Employment Issues -- TheNational Law Journal reports: "This year's presidential election could mean some big changes for employers, warn corporate counsel, who are bracing for everything from higher health care costs to more union organizing."  According to the article, a recent survey of nearly 400 corporate counsel, sponsored by the Association of Corporate Counsel and Jackson Lewis, revealed that six out of 10 corporate counsel believe that this year's presidential election will impact labor and employment laws at their companies, irrespective of which candidate wins.

The Lawyers' Role in Tonight's Debate -- Though you may not realize it, each campaign's team of lawyers played an important role in tonight's debate, according to the Los Angeles Times.  No, lawyers weren't busily preparing the candidates, as you might expect -- rather, they spent their time hammering out a 31-page agreement that governs where the candidates will sit (on stools, six feet apart on a horseshoe shaped stage) and what they can do (roam the stage freely, but not entertain follow-up questions).  Cameras are also prohibited from filming each candidate's reaction shots (which is one of the most interesting aspects of the debates, in my view).

Which Candidate Does Corporate America Support? --Corporate Counsel summarizes Corporate America's preferences in the election:

McCain has a slight lead in total donations from general counsel at Fortune 100 companies. Still, elite GCs are giving significantly more to Obama than they did to Al Gore or John Kerry, the previous two Democratic presidential nominees.

Does that surprise you, or not?

Is McCain Constitutionally Qualified for the Presidency? -- Back in February, we discussed the issue of whether McCain's place of birth -- a military base in Panama -- would disqualify him from the presidency because he would not be considered a natural born citizen, as required by the United States Constitution. Last week, the Michigan Law Review published an online symposium that deals exclusively with this issue.

While the quest for UN reform has been on the international agenda for decades, it has arguably reached an unprecedented level of visibility and urgency, being pursued at the highest levels of government and seen as a once-in-a-generation necessity. The UN reform agenda, aimed at coherence, efficiency and enhanced high-quality delivery is bound to have a major impact on UNESCO's action at the global, regional and country levels for the years to come. It will be a challenge, but also a real opportunity, for UNESCO.

In early 2006 The Secretary-General had commissioned a High-level Panel to explore how the United Nations system could work more coherently and effectively across the world in the areas of development, humanitarian assistance and the environment. The panel presented is report in November 2006. 

In mid 2006 the UN Secretary General produced a report proposing a set of new approaches and practices.
