Supreme Court Clerks Reaching (er, Representing) the Stars

No one has done more to glamorize and create a celebrity mystique for Supreme Court law clerks than David Lat at Underneath Their Robes. But the allure of the Hotties of the Law simply doesn't compare to the Hotties of Hollywood. And as this article, Supreme Court Connection:  High Court Clerks Tackle Entertainment Law ( Matthew Belloni -- Oct. 3, 2006), explains, Supreme Court clerks are trading in on their celebrity status in the small pond of the legal profession to represent big-time, Hollywood celebrities. Though generally, entertainment boutiques do not hire lawyers without experience, Supreme Court clerks have proven the exception to this rule. As Belloni reports:

The boutiques . do not hire . without experience.  Except when they do. Tara Kole and Theane Evangelis are first-year associates at two of L.A.'s most elite talent boutiques - Kole at Gang Tyre Ramer & Brown in Beverly Hills and Evangelis at Ziffren Brittenham Branca Fischer Gilbert-Lurie Stiffelman Cook Johnson Lande & Wolf in Century City - firms with client rosters among the most enviable in the business that rarely take on young associates, much less lawyers who are new to private practice. It might have helped that both Kole and Evangelis are the legal world's equivalent of young rock stars, having spent the 2004-05 term clerking for the U.S. Supreme Court, whose new term begins this week. Kole worked with Justice Antonin Scalia, Evangelis with now-retired Justice Sandra Day O'Connor.

The duo's credentials meant they likely could have selected anywhere to begin their careers - anywhere, the conventional wisdom goes, but the insular and highly specialized world of talent dealmaking. But the two managed to graduate from one of the most selective positions in law to one of the entertainmentindustry's toughest to crack. In the process, they exemplify both the level of legal talent the industry is attracting and, perhaps a bit disheartening for the community at large, the kind of credentials that may increasingly be required to break into the practice.

As of yet, entertainment law is not a popular choice for Supreme Court clerks. Describes Steven Krone (another Supreme Court clerk who went to the entertainment industry):

"Certainly I was a curiosity," Krone says. "There were 35 clerks my term. Half went to appellate divisions of Washington firms or the office of the Attorney General. One went to the Southern Poverty Center, and the rest went to traditional firms."

As law firm life grows more arduous for new associates, even the $200,000 signing bonuses that Supreme Court clerks can command may not be all that appealing. After all, when you can bask in the bright lights of Hollywood, why would you be content to be one of hundreds of associates, burning the midnight oil?

Does Technology Make Our Lives Easier?

The JD Bliss Blog poses the question of whether mobile technology helps or hinders work-life balance:

Some say the technologies keep employees tethered to the office 24/7, while others argue that the ability to communicate with the office and clients anytime, anywhere is liberating.

JD Bliss sites a study out of the United Kingdom, where 73 percent of respondents said that they have seen an improvement in their work-life balance as a result of  using mobile technologies. (But, as the post notes, the survey was  commissioned by Damovo UK, which provides mobile communication technologies to businesses). 

Meanwhile, another survey suggests the opposite result. According to this news release (October 2006):

A new university study and the ever-increasing use of wireless devices, such as the BlackBerry, could result in a flood of lawsuits against employers for creating an allegedly dangerous environment where unpaid overwork is required for success, promotion and job security, a leading law firm warns [...] Giving rise to possible claims, is a recent study by Gayle Porter, Associate Professor of Management at Rutgers University in New Jersey, which suggests possible liability for companies if they keep their employees on "electronic leashes" as part of their job requirements."We could easily see the plaintiff's bar pursuing class claims. In light of possible claims involving stress related illnesses, carpal tunnel, and for overtime, companies need to be proactive to avert possible serious monetary consequences," said Morris.

As with everything else, portable technology can bring enormous benefits, if used properly. I'd hate to see a situation where lawsuits resulted in the elimination of the mobile technology from the workplace. More than any other tool, BlackBerrys, cell phones and the Internet have increased our flexibility and enabled lawyers to work away from the office. The solution is not to get rid of the technology but to prevent employers from abusing it.

Justice Scalia Continues His Precedent of Controversy

Last term, it was a crude gesture to reporters; now it's a comment that some say perpetuates stereotypes against Mexicans. With the Supreme Court just starting its new session, Justice Scalia is continuing his precedent of generating controversy. As CNN describes here:

Justice Antonin Scalia opened the Supreme Court's new term Tuesday by questioning whether a man deported to Mexico after a drug conviction would be "abstaining from tequila" for fear of violating his U.S. parole terms.The remark came as justices heard an immigration case involving a Texas man, Reymundo Toledo-Flores, who was deported in April after being convicted of illegally entering the United States.

But though Scalia's comments have drawn lots of attention, are they as offensive as they appear? In her Supreme Court dispatch of the term, Dahlia Lithwick says yes, writing that we have a double standard for Scalia:

If George Allen had uttered Scalia's "nobody thinks your client is abstaining from tequila" crack today, it would have been front-page news. The rest of us would have been forced to form some opinion as to whether it was an "aspersion," a stereotype, a gaffe, or just a celebration of worm-laden beverages. But the court exists on a different plane, and for good reason. We don't want every branch of government to be beholden to the electorate, but that doesn't mean that the justices shouldn't be beholden to themselves. Scalia wants to be a part of the national conversation, but not on the terms the nation has agreed to. And each time he unleashes one of these remarks, I find myself wondering whether he's protecting his right to express himself, or just relishing his free pass.

But taking advantage of same day argument transcripts, Hot Air.com  reaches a different conclusion, by showing how the quote appears in context:

MR. CROOKS: For example, he should not use alcohol, he should not associate with persons.

JUSTICE SCALIA: We have a case involving standing which says that - you know, the doctrine of standing is more than an exercise in the conceivable. And this seem to me an exercise in the conceivable. Nobody thinks your client is really, you know, abstaining from tequila down in Mexico because he is on supervised release in the United States, or is going - is going to apply having been deported from the country for criminal offenses, he is going to apply to come back - and look, these are ingenious exercises in the conceivable. This is just not the real world.

From Hot Air's perspective, Scalia's remark equating tequila with Mexican alcohol is no different than equating sake with Japanese alcohol or vodka with Russian alcohol.

Trial Lawyers Collaborate on Web Site

If you think that trial lawyers constantly compete with each other for top cases, think again. The newly created Trial Lawyer Resource Center (TLRC) is a hot-off-the-presses blog that represents the collaborative efforts of 10 trial lawyers. Some of the collaborators, like David Swanner of South Carolina Trial Law Blog, John Day of Day on Torts, Mark Zamora of A Georgia Lawyer and Ron Miller of Maryland Injury Lawyer Blog may already be familiar names from the blogsphere. Here's how the TLRC blog describes its purpose:

[this is a blog where a] number of the USA's top trial attorneys join together with litigation experts to lend their expertise on topics that matter in your trial practice. Gain insight in case selection, work up, trial strategy, evidence, and post settlement issues. Contributors will reqularly share their real life experiences and knowledge to help you represent injured consumers.

But there's something even more radical about the TLRC besides collaboration and the wealth of information that it will provide to other lawyers at no cost. Traditionally, resources provided by the American Trial Lawyers Association (ATLA; soon to be known as the American Association for Justice) has limited certain membership benefits, such as listserve participation, to plaintiffs lawyers. But the lawyers at TLRC apparently have no compunction about sharing their secrets, not just with other plaintiffs lawyers but with the defense bar as well. My guess is that TLRC will find a major audience not just with plaintiffs lawyers but with their adversaries as well.

Would Silicon Valley Have Been as Successful With Stodgier GCs?

In the wake of recent scandals related to pretexting and backdating of stock options, Asbhy Jones of The Wall Street Journal considers  the role of the in house counsel at Silicon Valley companies in Silicon Valley's Outsiders:  In-House Lawyers? (WSJ Online, October 2, 2006).  Jones writes:

Lately, two scandals -- Hewlett-Packard Co.'s board-leak investigation and the backdating of stock options -- are shining a light on the role of in-house lawyers at Silicon Valley technology companies.  Those situations each present different facts. But lawyers inside and outside the valley say in-house lawyers at technology companies sometimes lack the respect the position commands elsewhere. One indication: Some big Silicon Valley companies don't have general counsel -- the title typically conferred on top in-house attorneys.

Among other things:

General counsel in Silicon Valley are still sometimes "seen as a blockage to the execution" of the company's plans, says Scott Bohannon, general manager of the General Counsel Roundtable, a Washington research organization.

As a result, "No -- the message in-house lawyers often have to deliver -- isn't the message some driven entrepreneurs want to hear."

Jones points out that at large, more established companies, in house GCs were once relegated to the position of second fiddle.  But:

In the past 20 years, however, general counsel have won a stronger voice with senior executives and directors. One key figure in that development was Benjamin Heineman Jr., the top lawyer at General Electric Co. from 1987 to 2005. Heineman recruited high-powered legal talent. Many of his protégés went on to become strong and respected top lawyers elsewhere, including Maura Abeln Smith at International Paper Co. and Jeffrey B. Kindler at McDonald's Corp. and Pfizer Inc. Kindler was named Pfizer's chief executive in July.

One message of those interviewed for Jones' piece is that as the high-tech industry grows and matures, companies will need stronger in house counsel who won't, as Brad Wendel describes, turn a blind eye to inconvenient facts.   But at the same time, Jones' piece also makes me wonder:  would the Silicon Valley companies have had the same success with more assertive GCs?

Is Justice for Sale in Ohio?

Is justice for sale in Ohio?  Or do coincidence or inaccurate study metrics explain the correlation between campaign contributions and rulings by the Ohio Supreme Court?  These are some of the questions explored in this extensive New York Times report by Adam Liptak and Janet Roberts, Campaign Cash Mirrors A High Court's Rulings.

Among the article's findings:

An examination of the Ohio Supreme Court by The New York Times found that its justices routinely sat on cases after receiving campaign contributions from the parties involved or from groups that filed supporting briefs. On average, they voted in favor of contributors 70 percent of the time. Justice O'Donnell voted for his contributors 91 percent of the time, the highest rate of any justice on the court.

In the 12 years that were studied, the justices almost never disqualified themselves from hearing their contributors' cases. In the 215 cases with the most direct potential conflicts of interest, justices recused themselves just nine times.

In accordance with the code of judicial ethics, judges frequently recuse themselves from cases where they have a financial interest that might create even an appearance of impartiality -- for example where a judge holds stock in a litigant's company.  But according to the article, campaign contributions have been considered an exception to the financial interest recusal rule.
As the article explains:

Many judges said contributions were so common that recusal would wreak havoc on the system. The standard in the Ohio Supreme Court, its chief justice, Thomas J. Moyer, said, is to recuse only if "sitting on the case is going to be perceived as just totally unfair."

Still, if you think that this article will result in reforms, such as mandatory recusals in cases where judges have taken campaign contributions, or replacing judicial elections with appointment, think again.  For starters, the justices interviewed for the article do not believe that recusal would result in change:

None of the justices interviewed suggested that more frequent recusals from contributors' cases would be a positive step rather than a recipe for havoc. Last year, though, five justices did recuse themselves from a case involving a Republican fund-raiser, Thomas W. Noe. They had taken $23,510 from Mr. Noe and his wife. Appeals court judges filled in for the justices.

Others, apparently, do not even acknowledge a problem with the existing system:

Justice O'Donnell, who has raised more than $3 million since 2000, refused to be interviewed for this article despite more than a half-dozen requests to his campaign, his chambers and the court. In a statement, he said, "Any effort to link judicial campaign contributions received by a judicial campaign committee for major media advertising to case outcomes is misleading and erodes public confidence in the judiciary."

If anything, the article gives incentive for non-business groups to work harder to outspend their opponents.  The article notes that:

Not long ago, the Ohio Supreme Court was controlled by liberal justices whose campaigns had been financed in large part by plaintiffs' lawyers and unions. Now that business groups are outspending their adversaries, the court has become dominated by more conservative justices. And the court's decisions are no longer markedly sympathetic to people claiming injuries[...]

"The current wars are epic battles between businesses and trial lawyers," said Bert Brandenburg, the executive director of Justice at Stake. "Over the past half-decade, business groups are outraising and outspending trial lawyers."

In short, why should interest groups spend their money on developing an impartial system, when it's easier to spend the money to buy the judges you want instead?

Preview of the Supreme Court's October Calendar

In this article, A Look Ahead to the First Oral Arguments of the New Supreme Court Term, Howard Bashman of How Appealing previews some of the questions that the Supreme Court will address when the court starts its new session on Oct. 3.   Of the nine cases scheduled for Oct. 3-11, four come from the 9th Circuit.   These include:  United States v. Resendiz-Ponce, which presents the question whether the omission of an element from a federal indictment can constitute harmless error (9th Circuit says no); Global Crossing Telecommunications, Inc. v. Metrophones Telecommunications, Inc., on whether a provider of pay phone services can sue a long distance carrier for alleged violations of the Federal Communications Commission's regulations concerning compensation for coinless pay phone calls (9th Circuit says yes); Cunningham v. California, a sentencing case involving whether whether California's Determinate Sentencing Law violates the 6th and 14th amendments to the U.S. Constitution by permitting California state court judges at sentencing to impose enhanced sentenced based on their determination of facts neither found by the jury nor admitted by the defendant; and  Carey v. Musladin, reviewing the 9th Circuit's decision to overturn a murder conviction of a defendant who claimed he was denied a fair trial because the victim's relatives appeared in court wearing buttons with the deceased's picture on them.

Bashman doesn't hold out much hope that the 9th Circuit's reputation as the most overruled circuit will change this term.  He concludes:

Although none of the 2006 term's blockbuster opinions may emerge from the Court's very first oral argument session, it does appear that the 9th Circuit is well on its way to being reversed in at least three of the four cases to be argued in October.

More than 125 million Brazilians went to the polls Sunday to vote for president and to select governors for all 26 states and the Federal District, as well as all 513 Federal Deputies of the lower house and 27 of Brazil's 81 Senate seats. By the end of the day, in a breathtaking counting process that held the nation in suspense waiting for the results, President Luiz Inacio 'Lula' da Silva missed a first round victory falling 1.4 percentage points short of the 50 per cent he needed to avoid a runoff on October 29. The numbers are the main facts, but the bloggers diverse narratives and interpretations of the results are just the start of a debate that promises to get hot. 


"Houve uma surra de Lula no Norte e Nordeste, e uma surra de Alckmin no Sul e Centro-Oeste, enquanto a região Sudeste está dividida", afirmou. Isso aconteceu, segundo Amorim, porque as regiões Sul e Centro-Oeste, em que o agronegócio tem um peso importante, "estão em recessão". As economias do Norte e do Nordeste cresceram acima da média nacional, impulsionadas pelos programa sociais do governo e pela redução no preço dos alimentos possibilitada pelo dólar baixo. Desde 1990, quando as eleições estaduais no Brasil passaram a ter a possibilidade de 2º turno, já houve 17 “viradas” quando o segundo colocado acaba se tornando o primeiro e acaba vencendo a disputa. Hoje, esse é o sonho dos tucanos e o pesadelo dos petistas... Da 17 “viradas” entre 1º e 2º turnos em eleições estaduais, só 7 ocorreram quando diferença entre os dois candidatos no 1º turno foi superior a 7 pontos (a distância agora entre Lula e Alckmin). Nos outros 10 casos (a maioria), os dois candidatos já foram para a disputa final muito próximos. O que isso quer dizer? Quer dizer que estatisticamente o caso Lula X Alckmin não está dentro dos padrões da maioria das “viradas” entre 1º e 2º turnos –embora já tenham sido registrados casos semelhantes em que esse tipo de reviravolta aconteceu.

Today, this is PSDB's dream and PT's nightmare... Of the 17 'reversals', only 7 occurred when the difference between the candidates was bigger than 7 points (the actual gap between Lula and Alckmin). In the other 10 cases (the majority), the candidates entered the run-off very close to each other. What does this means? That the case Lula vs. Alckmin is statistically out of the pattern that ruled the majority of the reversals in run-offs - although we already have had such an event.

The differences between them is revealed in the answers given to questions related to the dossier-gate. "The Brazilian society is waiting for answers", said Alckmin. "Whose is the money [R$ 1.7 million]? Who owns the [bank] accounts? Whose are the dollars? How did they enter the country? The Brazilian people need answers that were not given". These are answers that Lula still dosen't have. In his private ruminations, the president suspects that the 'crazy' PTists who tried to buy a dossier incriminating  opposition candidates got trapped by an ambush. In the interview, Lula managed to insinuate his suspicions: "I keep praying to God that nothing happens to me until I solve this mystery. It is not only a question of money, or finding where it came from. I want to know who engineered this plot that made the party shoot it's own foot. I pray to God to live until the day I am able to say: this was the one who executed the maneuver".

Confirming the morning mood, Bovespa closed today with expressive heights (1.67%)  in what was seen as a commemoration of Alckmin achieving the run-off. Operators said that privatizable or already privatized companies were valued. That is, they think Alckmin will bring back privatization, which is excellent business for the stock exchange. It is known that markets work on anticipation, but this time it seems they are exaggerating. You have people trying to hand you little pieces of paper saying to vote for this party or that party for deputy, governor, president, etc. That would be fine if the papers told you the candidates' positions, but they don't. They just say, "press number XXXX" (here, voting is electronic, and remarkably simple). As a result, you get poor people hired by elitist parties handing out leaflets that are immediately thrown on the ground because nobody wants them, being fed up with all the political garbage, and the urban pollution skyrockets in the weeks before the election.

Where Are the Pro Bono Attorneys When You Need Them?

oximately 20 capital cases. It is unclear whether I will be paid at all, even though by Supreme Court standards this could be full-time employment for the next five years.

Last year, lawyers came to the rescue to help out their colleagues in the aftermath of Katrina. Let's not forget that some, like Doskey and his clients, still need assistance. This sounds like a neat pro bono projects for law firms, with potential for a jury trial and perhaps, down the line, an appeal to the U.S. Supreme Court (which plenty of law firms are avid to obtain). Any takers?

Discovery Pays, but Sometimes, Plaintiffs Pay for Discovery

Ah, the amazing possibility of electronic discovery, which allows litigants access to every little shred of e-mail, every memo and every PDA entry ever created on the company computer. Surely, somewhere in all of those megabytes of data, a plaintiff suing for discrimination is bound to find a smoking gun. But not always, as Craig Williams of May It Please the Court describes in this post.

Williams blogs about the recent federal court decision in Claudia Quinby v. WestLB AG, No. 04 Civ. 7406, S.D. N.Y. , where the plaintiff "couldn't seem to fashion a good question to get the discovery results she wanted," even though defendants ran up nearly a quarter-million-dollar tab in an effort to respond  to plaintiff's request. Consequently, as Williams writes, since "the court found that since the results were something very much less than spectacular, the Plaintiff should bear some of the cost, and shifted some $30,000.00 to her. "

As we all know, discovery can pay. And as Quimby bears out, when discovery doesn't pay, the party seeking it (in this case the plaintiff) just might pay instead.

Now, Fastow and Olis Have Something in Common: Six Years

It's not often that we're happy to get less than what we bargained for. But presumably, former Enron executive Andy Fastow is elated with the six-year prison sentence he received for his role in the criminal activity that brought the demise of Enron as reported in articles like this one at Forbes. After all, Fastow had originally agreed to a 10-year sentence in exchange for his cooperation with prosecutors, which he'd testified about in some detail during the Skilling-Lay trial.

The six-year sentence gives Fastow something in common with Jamie Olis, the midlevel Dynegy executive we blogged about here last week. But as Tom Kirkendall of Houston's Clear Thinkers writes, six years is about all the Fastow and Olis have in common. From this  Kirkendall post:

On one hand, Andrew Fastow --  who served up his wife as a sacrifical lamb for his embezzlement of millions from Enron that triggered one of the largest bankruptcy cases in U.S. history, who used the NatWest Three to hide his embezzlement of millions more and then turned on the U.K. bankers to save his skin, who very well may have forged Richard Causey's initials on the Global Galatic "agreement," whose bizarre testimony during the Lay-Skilling trial was largely discounted by jurors and who had a large hand in ruining the careers of four innocent Merrill Lynch executives in order to lessen his prison sentence -- is sentenced to six years in prison.

On the other hand, Jamie Olis -- who worked on a transaction to improve his company's earnings, did as he was told by his superiors, did not profit from the transaction, defended his company and himself against allegations of wrongdoing with regard to the transaction and did not trigger any type of insolvency case by his company -- is sentenced to six years in prison.

Morever, as Austin defense lawyer Jamie Spencer points out in this post, Judge Lake reduced the Olis sentence to six years expressly because the fraud involved was not meant to defraud the company or its shareholders and was not meant to enrich the defendant. Seems that under Judge Lake's standard, Fastow doesn't deserve a six-year sentence, whether he cooperated or not.

So what explains the Fastow sentence? Is it simple irrationality as Kirkendall suggests? Did a good word from Enron shareholders, now involved in class action litigation against Enron that has been aided by Fastow's continued cooperation make a difference, as noted in Peter Lattman's WSJ Law Blog post? Or is this the kind of leniency that defendants can expect in exchange for cooperation with the government and foregoing rights to a jury trial, as suggested by Ellen Pogdor at the White Collar Crime Blog

Maybe by the time Fastow and Olis are released from prison, we'll have figured out a way to punish and deter corporate crime while maintaining some semblance of fairness in our system of justice.

Why Lawyers Work -- It's Not All About the Billables

Sometimes, it's hard to remember that lawyers work for anything but money, with the focus on stratospheric associate salaries, the obsession with billable hours and the general public perception of lawyers as money-grubbers. But as Arnie Herz of Legal Sanity reminds us in this post, lawyers work not just for money. Herz cites a couple of articles that discuss why we work, including this piece, Why Do We Work? by Jenner & Block lawyer Gregory Gallopoulo s. Gallopoulos identifies many reasons that lawyers work, including intellectual growth, personal and institutional pride and recognition. He concludes:

Why do we work? For money, but also for sanity. We expect and need to be compensated in nonmonetary ways. Noneconomic compensation matters to top-flight lawyers -- otherwise, they would have long ago fled to investment banks. Law firms that want to recruit and retain the best (and the sanest) must compensate not only in dollars but also in psychic gratification. Accordingly, managers of elite firms need to think consciously about what lawyers are looking for beyond money.

If your legal career isn't bringing you much more than dollars, perhaps it's time you asked yourself a different question: Why am I working as a lawyer at all?
