Lawyer or a no -too lawyer?

Are You a Go-To Lawyer or a No-Too Lawyer?
Lawyers can be placed into two different categories:  "go to" lawyers, the type of proactive, can-do lawyer who everyone  wants to work with and "no too" lawyers (as in "I'll say no to that too"), who always tell clients what they can't do.   In this post, Larry Bodine describes the characteristics of each.  According to Bodine, go-to lawyers are up-to-date on the law, grasp their clients' strategic issues and "put some skin in the game," by sharing risks with clients.  By contrast, no-too lawyers reflexively tell clients no, don't bother to learn about the client and its business environment, don't return phone calls or keep current on issues.

Bodine wants to know: "Which lawyer are you?"

'BE IRREPRESSIBLE! A CAMPAIGN FOR GLOBAL INTERNET FREEDOM'

As more and more nations carve up the so-called global, borderless internet into separate spheres of control through filtering and censorship, often using technology supplied by large IT companies, Amnesty International has launched a new campaign - irrepressible.info to raise awareness of and protest against the infringements on the basic human right of freedom of speech.

Chat rooms monitored. Blogs deleted. Websites blocked. Search engines restricted. People imprisoned for simply posting and sharing information.

The Internet is a new frontier in the struggle for human rights. Governments – with the help of some of the biggest IT companies in the world – are cracking down on freedom of expression.

There are specific examples of some of the countries and companies in the spotlight:

The web is a great tool for sharing ideas and freedom of expression. However, efforts to try and control the Internet are growing. Internet repression is reported in countries like China, Vietnam, Tunisia, Iran, Saudi Arabia and Syria. People are persecuted and imprisoned simply for criticising their government, calling for democracy and greater press freedom or exposing human rights abuses, online.

But Internet repression is not just about governments. IT companies have helped build the systems that enable surveillance and censorship to take place. Yahoo! have supplied email users’ private data to the Chinese authorities, helping to facilitate cases of wrongful imprisonment. Microsoft and Google have both complied with government demands to actively censor Chinese users of their services.

The campaign has three main points of action - firstly urging people to sign a pledge on internet freedom, secondly encouraging individuals to undermine censorship by publishing "irrepressible" fragments on censored material on personal sites and thirdly to take action on behalf of imprisoned Chinese journalist Shi Tao

The second option involves putting a piece of javascript on your site which will generate a box containing random pieces of censored information. If the reader clicks on the box they are taken to the campaign page where, not entirely obviously, there is more information about where the random piece of information originated and a url to the censored website.

The fragments are generated from a database of censored material which is being compiled by the OpenNet Initiative which also has an interactive map with a geographical representation of their detailed research into national efforts to filter the internet.

At least 200 people signed the internet freedom pledge in the time it took me to write this post, according to the counter on the irrepressible.info main page, bringing the total to nearly 13,000 signatures. Let's make some noise, and make a difference.

'SPECIAL INDONESIA EARTHQUAKE BLOG'

The helps and donations which come from around the globe on the 6.2 richter scale earthquake in Yogyakarta, Central Java, Indonesia have been heartening.  Indonesians  outside Yogyakarta also watch the post-earthquake news very closely some of them a bit confused as to how to make donation and to which institution they can channel their donation through.

To meet all these, the second largest Indonesian university Universitas Gadjah Mada (UGM),  Yogyakarta has set up a special blog dedicated specifically to it to give a complete information services: from minute to minute progress, up-to-date news, and information on some institution you can send your donation to along with bank account numbers to transfer money, some very important telephone numbers to contact, and some relief effort institutions addresses which just set up emergency offices there

The UGM students certainly have done a good job by setting up the emergency special earthquake relief effort blogHaving said that, considering the magnitude of the natural disaster with international interests, they should consider to make the blog into bi-lingual to enable the blog accessible to international readers.

Civil

Recurso de Casación en el Fondo rechazado. Demanda civil de indemnización de perjuicios por responsabilidad extracontractual. Infracción a los artículos 1, 5 y 19 Nº1 de la Constitución Política de la República, que reconocen la dignidad de la persona humana, y aseguran su integridad psíquica y física; del artículo 38 inciso 2º de la Carta Fundamental que consagra la responsabilidad extracontractual de la Administración del Estado.

Recurso de Apelación rechazado. Juicio Ejecutivo. Avenimiento de autos es una transacción que ha puesto término al juicio, y que en caso de incumplimiento sólo da derecho para iniciar un nuevo juicio. Artículo 775 del Código de Procedimiento Civil.

Recurso de Apelación acogido. Juicio Ejecutivo. Tercería de Posesión. presunción del artículo 700 del Código Civil. Demandadas no rindieron prueba alguna para desvirtuar las pretensiones del actor, ya que la causa se siguió en su rebeldía. Alzamiento del embargo impugnado.

Laboral

Recurso de Casación en el Fondo inadmisible. Juicio Laboral. Vulneración de los artículos 174 del Código del Trabajo en relación al 10 y 1.687 del Código Civil. Se declaró nulo el despido de la actora porque este gozaba de fuero laboral y el demandado no solicitó la autorización judicial correspondiente.

Recurso de casación en el Fondo rechazado. Juicio Laboral. Quebrantamiento de los artículos 1.545, 1.560, 1.562 y 1.566 del Código Civil. El fallo recurrido al decidir que el trabajo se encontraba ligado con una orden de servicio y no con el contrato que la demandante celebró con Codelco, habría vulnerado el espíritu y el texto de la cláusula contenida en el contrato de trabajo vigente.

Recurso de Casación en el fondo rechazado. Juicio Laboral. Infracción de los artículos 426 y 442 del Código del Trabajo, 19 Nº 3 de la Constitución Política de la República y 19 a 24 del Código Civil. Violación a las normas del debido proceso al dejarlo en la indefensión por declararse extemporánea su prueba, no obstante haberla acompañado dentro del plazo legal.

Recurso de Casación en el Fondo rechazado. Juicio Laboral. Quebrantamiento de los artículos 19 Nº 15 de la Constitución Política de la República y 2.053, 2.058 y 545 del Código Civil. Sociedad demandada es una sociedad de hecho que no puede ser legitimada pasiva del actual pleito, no es capaz de ejercer derechos y de contraer obligaciones civiles, correspondiendo que sus asociados fueran condenados solidariamente al pago a sus asociados, los sentenciadores han hecho aplicación falsa de las normas que por medio de este recurso se dan por infringidas.

Recurso de Casación en el Fondo rechazado. Juicio Laboral. Infracción a los artículos 2 inciso primero de la Ley Nº 3.918 y 1.560, 2.465 y 2.469 del Código Civil. Socios de una sociedad de responsabilidad limitada responden por el monto de sus aportes o a lo más, la suma que se indique en el acta constitutiva. En el fallo recurrido se expresa que no se puede perseguir el patrimonio personal de los socios de una sociedad de responsabilidad limitada, naturaleza que posee la sociedad demandada para solucionar las obligaciones que dicha sociedad contrajo con terceros, en este caso, los trabajadores.

Recurso de Casación en la Forma inadmisible. Juicio Laboral. Causal 5del artículo 768 del Código de Procedimiento Civil, en relación con el artículo 170 del mismo texto legal, Auto Acordado sobre la Forma de las Sentencias, numerales 6 y 7, fundado en que el fallo de primer grado habría omitido analizar los testigos presentados por su parte para acreditar que el empleador de los actores era el demandado.

Comercial

Recurso de casación en el Fondo acogido. Reclamo de ilegalidad. Rechazo a la solicitud de giro de patente comercial, por problemas de zonificación y de conformidad con el artículo 26 del D.L. Nº3.063. Infracción a artículos 342 y 346 del Código de Procedimiento Civil. Cumplimiento de los requisitos establecidos en los artículos 25 y 26 de la Ley de Rentas Municipales y en concordancia con los artículos 1.700, 1.702 y 1.706 del Código Civil.

Administrativo

Recurso de Casación en el Fondo rechazado. Expropiación. Transgresión de los artículos 9º letra B) del D.L. Nº2.186; 341, 342 Nº3,384 regla 2º y 425 del Código de Procedimiento Civil; y 1698, 1700 y 1702 del Código Civil. Sentenciadores le agregaron un requisito no contemplado.

Recurso de Casación en el Fondo rechazado. Expropiación. Reclamación. Artículo 9º letra b) del D.L. 2186 en relación con el artículo 19 del Código Civil, y 1698 de este último texto legal. Terreno no expropiado resulta prácticamente imposible de explotar o aprovechar como consecuencia o efecto de la expropiación.

Recurso de Apelación acogido en cuanto a la legitimación pasiva y rechazado en cuanto a la indemnización. Demanda de indemnización de perjuicios por falta de servicios en contra del Fisco de Chile. Funcionarios que trabajaban en el Servicio de Impuestos Internos y del Servicio Nacional de Aduanas, es decir agentes que trabajan para el Estado, posibilitaron la actuación ilícita. Disposiciones constitucionales, artículos 1º, 6º, 7º inciso final, 38 inciso 2º y la Ley 18.575. insuficiencia de pruebas para indemnizar.

Constitucional

Recurso de Apelación de Protección acogido. Vulneración de la garantía de igualdad ante la ley contemplada en el artículo 19 Nº 2 de la Constitución Política de La República. Proceder por vías de hecho a ocupar la hijuela que estiman les pertenece, alteraron una situación fáctica existente por varios años -desde 1979 aproximadamente-, apartándose de la legalidad vigente.

Tributario

Recurso de Casación en el Fondo rechazado. Juicio Tributario. Infracción a los artículos 31 Nº6 de la Ley de Impuesto a la Renta, y artículos 21 y 26 del Código Tributario. Falta de aplicación, aplicando, en cambio, erróneamente el artículo 33 Nº1 letra B) de la Ley de la Renta.

Recurso de Casación en el Fondo rechazado. Juicio Tributario. Infracción a los artículos 14 letra A) Nº 1, 21 y 33 Nº1 de la Ley de Impuesto a la Renta, 21 del Código Tributario y 19 del Código Civil. La norma establece como regla general, que las rentas provenientes de las empresas, individuales o colectivas, se afectarán con los Impuestos Global Complementario o Adicional, cuando efectúen retiros o distribuciones a sus propietarios, socios o accionistas.

Recurso de Casación en la Forma y en el Fondo rechazados. Juicio Tributario. Artículo 768 Nº1 del Código de Procedimiento Civil, consistente en haber sido la sentencia pronunciada por un tribunal incompetente o integrado en contravención a la ley. Delegación de funciones jurisdiccionales. La incompetencia debió ser alegada en otra etapa del juicio.

Recurso de Apelación. Nulidad declarada de oficio por el tribunal. Juicio Tributario. Delegación de funciones jurisdiccionales. Artículos 6º, letra B, Nº 7 y 116 del Código Tributario, y 20 de la Ley Orgánica del Servicio de Impuestos Internos.

Procesal

Recurso de Hecho declarado inadmisible. Recurso de Queja en contra de juez árbitro. Artículo 63 Nº1 letra c) del Código Orgánico de Tribunales y 188 del mismo cuerpo legal. Sentencia pronunciada respecto de este recurso, en contra de un juez árbitro es inapelable.

Al respecto, señala que ha contravenido los números 8 y 16 del artículo 198, en relación a los artículos 138 y 139 de la Ley de Tránsito.

Recurso de Casación en el Fondo rechazado. Juicio Criminal. Cuasidelito de lesiones graves. Demanda.de indemnización de perjuicios. Infracción a los artículos 459, 485 y 488 del mismo precepto legal, y los art ículos 490 y 492 del Código Penal.

Juicio Criminal. Delito de abusos deshonestos sancionado en el artículo 366 bis del Código Penal. Causal 1a. y 7a. del artículo 546 del Código de Procedimiento Penal. Bush Likens War on Terrorism to Cold War

WEST POINT, N.Y. (AP) -- President Bush, likening the war against Islamic radicals to the Cold War threat of communism, told U.S. Military Academy graduates on Saturday that America's safety depends on an aggressive push for democracy, especially in the Middle East.

 

The president took a subtle jab at Syria and the nuclear ambitions of Iran. He chided previous U.S. administrations, saying that decades of excusing and accommodating the lack of freedom in the Middle East did nothing to make America safer.

 

"This is only the beginning," Bush said. "The message has spread from Damascus to Tehran that the future belongs to freedom, and we will not rest until the promise of liberty reaches every people in every nation."

Bush delivered his 35-minute foreign policy address to 861 cadets, all clad in crisp white slacks and gray jackets. Overcast skies threatened rain but did not dampen the graduates' enthusiasm for the president's tough talk against terrorism.

"The war began on my watch, but it's going to end on your watch," Bush told the cadets. "By standing with democratic reforms across a troubled region, we will extend freedom to millions who have not known it and lay the foundation for peace for generations to come."

Bush compared his moment in presidential history to that of President Truman's.

"As President Truman put it towards the end of his presidency, 'When history says that my term of office saw the beginning of the Cold War, it will also say that in those eight years we set the course that can win it.' His leadership paved the way for subsequent presidents from both political parties - men like Eisenhower, Kennedy and Reagan - to confront and eventually defeat the Soviet threat," Bush said.

"Today, at the start of a new century, we are again engaged in a war unlike any our nation has fought before, and like Americans in Truman's day, we are laying the foundations for victory."

 President Bush says the U-S will not surrender in the war on terror.

Normally, Chilean Bloggers have common concerns in their Blogs, but this week coordination just doesn’t happen. So, this is a cocktail of news.

 Leo Prieto (ES) , post about his interview with the sub-secretary of telecommunications government to promote banda ancha to Chile. This initiative was with the support of Atina Chile (ES). Mostly of the politics have in their speech these concerns, but they don’t get into action. As a result of this, common people involve are introducing the subject into politics concerns.

EL PROFESOR LUIS RIVEROS DIALOGA CON ACADÉMICOS
DEL INSTITUTO DE CIENCIAS BIOMÉDICAS:

En su segundo encuentro con parte de los 200 académicos que componen en el Instituto de Ciencias Biomédicas (ICBM), y luego de subrayar su intención de mantenerse en el cargo de Rector por no menos de los cuatro años que éste estipula –ello “porque mi meta es completar la instalación de la nueva institucionalidad y después trabajar en el nuevo proyecto estratégico  de la universidad de cara al 2010”–, el académico y candidato, Prof Luis Riveros, reiteró que lo que debe primar dentro de la campaña electoral universitaria es el debate sobre ideas y no las descalificaciones.

Hermógenes : Como hijo del Rigor jurídico, me voy a mi “palm” , porque a golpe de  un lapicito, logro una definición  o cientos de ellas como todos también decenas de  los códigos más empleados , todas las doctrinas y todos los fallos en una materia determinada. Porque la memoria suele fallar.  Veo Estado de derecho ya que un ciudadano me pregunta que es esto que tanto se habla y al parecer hoy ya no se practica: veamos

El Estado de Derecho es un tipo de Estado. El Estado de Derecho es un concepto de teoría política, jurídica y moral y dice que la autoridad del gobierno sólo puede ser llevada a cabo siguiendo leyes escritas, las cuales deben haber sido adoptadas mediante un procedimiento establecido. No cualquier Estado ni cualquier Derecho conforman un Estado de Derecho; únicamente, aquel Estado controlado por el Derecho y aquel Derecho legitimo (democrático). El principal rasgo del Estado de Derecho es el principio de legalidad también conocido como Imperio de la ley.

El Estado de Derecho, además, es un Estado cuyo Derecho protege y garantiza determinados derechos y libertades que históricamente se consideran fundamentales. Otro rasgo característico habitual en un Estado de Derecho es que dentro de sí, el Estado de Derecho mantiene una separación de las funciones legislativa, ejecutiva y judicial.

RESPONSABILIDAD SOCIAL EMPRESARIAL, CONFERENCIA INTERAMERICANA

Washington -- Entre el 25 y 27 de septiembre se realizará en Santiago de
Chile una conferencia interamericana sobre la responsabilidad social
empresarial, para examinar la premisa de que las personas que se involucran
directamente con una compañía (ya sea en su calidad de empleados,
accionistas o consumidores) tienen el deber de asegurarse de que las
empresas contribuyan al bien común de la sociedad.

En una declaración difundida el 29 de agosto el Banco Interamericano de
Desarrollo (BID), uno de los patrocinadores del encuentro, dijo que entre
los oradores en la conferencia participarán representantes de las grandes
empresas, conocidas por sus esfuerzos para promover la responsabilidad
social empresarial. También participarán en el encuentro representantes de
organizaciones de la sociedad civil, de organismos internacionales y del
mundo académico.

Entre los oradores cabe mencionar a Larry Palmer, presidente de la
Fundación Interamericana
, una agencia independiente del gobierno de Estados
Unidos. La Fundación concede ayudas a organizaciones no gubernamentales y
asociaciones comunitarias en América Latina y el Caribe, para programas
innovadores de iniciativa personal, cuya finalidad es mejorar la calidad de
vida de la gente pobre en la región. Palmer hablará sobre el papel del
gobierno en lo que se refiere a proporcionar incentivos de responsabilidad
social empresarial.

El principio rector de la responsabilidad social empresarial, que ha
alcanzado amplia aceptación en los últimos años, sostiene que las compañías
tienen la obligación de administrar sus prácticas comerciales de manera que
produzcan un impacto positivo general en la sociedad. Según el BID "las
empresas socialmente responsables tienen un propósito que va más allá de
las ganancias. Su meta es lograr resultados netos con triple objetivo, o
sea: resultados financieros, crecimiento económico sostenible con más y
mejores puestos de trabajo y mayor igualdad social".

Bajo el lema de "¿Quién es responsable de la responsabilidad?" la
conferencia examinará cómo una compañía debe asegurar su responsabilidad
social -- ya sea a través de la regulación y la legislación nacional o bien
a través de prácticas voluntarias o una mezcla de ambas.

Antonio Vives, funcionario del BID que coordina el encuentro en Santiago,
dijo que la "idea tradicional de que la empresa es la responsable de su
responsabilidad y de que el resto de las partes interesadas sólo exigen, ha
pasado de moda".
Agregó que "las partes interesadas tienen también deberes,
no sólo derechos, y entre ellos, el más importante es contribuir,
responsablemente, a que la empresa sea responsable".

Vives, subgerente de Empresa Privada y Mercados Financieros en el BID, dijo
que buena parte del colapso financiero de la compañía Enron en el 2001 --
en el que accionistas de la empresa con sede en Houston sufrieron inmensas
pérdidas monetarias -- y de "la irresponsabilidad de otras empresas se debe
a la falta de acción de las partes interesadas".

El BID dijo que la conferencia en Santiago estudiará también la experiencia
pertinente de las industrias de la minería y los hidrocarburos en América
Latina y el Caribe, y se establecerá cuáles son las obligaciones de estas
compañías y qué esferas escapan a su alcance.

ABA Judical Ratings: Love 'em or Hate 'em
As a lawyer who serves as a neutral arbitrator, it sometimes seems to me that if both parties come out of a case unhappy with my decision, I probably came down right about near the middle ground. So it may be with the American Bar Association Standing Committee on the Federal Judiciary, which evaluates the qualifications of all federal judicial nominees.

Yesterday, the committee gave its lowest rating of "not qualified" to Michael Wallace, President Bush's nominee for the 5th U.S. Circuit Court of Appeals. Earlier this week, the committee downgraded its evaluation of Brett M. Kavanaugh, the president's nominee for the U.S. Court of Appeals for the D.C. Circuit. Liberals responded to these evaluations by calling for the withdrawal of both nominations, while conservatives responded by attacking the ABA committee as biased.

At the conservative blog PointofLaw.com, for example, Ted Frank said that Kavanaugh's downgrading proved the position Bush took early in his administration that the ABA's ratings were biased. At ProfessorBainbridge.com, Stephen Bainbridge dug into campaign finance data for evidence of political leanings among any of the ABA committee members. Nine of the 15 committee members had made federal campaign contributions, he found, six primarily to Democrats and three primarily to Republicans. From this, he speculates:

"If the political leanings of the non-givers track those of the givers, Democrats may hold a 10-5 advantage on the committee."

Of course, all this data really shows is that fewer than half the committee's members supported Democrats. As might be expected from the name, Club Lefty takes a contrary view. He visited the official White House Judicial Nominations page to find multiple instances when the president cited the ABA ratings as affirmative evidence of a nominee's qualifications. He says:

"A quick scan of previous reactions to ABA ratings of high profile judges demonstrates what can only be considered a long standing track record of support from the administration for the findings of the ABA."

Among recent Bush nominees, the ABA committee gave its "well qualified" ratings to both Samuel Alito and John Roberts. When you walk a middle line, how others see you depends on their perspectives. Some see you veering to the right, others see you veering to the left. In truth, if the committee had been veering one way or the other, it wouldn't have stayed on track all these years.

Must-Have Skills for Corporate Counsel
A survey of 780 Canadian corporate counsel asked them to select the most important skill for the job. At the top of the list, as Rees Morrison reports at Law Department Management, was "effective leadership," ranked first by 21 percent of respondents. Other key skills they listed were:

  • Business sector knowledge (19 percent).
  • Accounting/financial (14 percent).
  • Management (11 percent).
  • Project management (8 percent).
  • Technology (7 percent).
  • Negotiating (7 percent).
  • Presentations/speaking (5 percent).
  • Skills assessment/mentoring (4 percent).

Notably absent from the list, Morrison says, were emotional intelligence and ability to write clearly.  Further, concludes Morrison:

"If 'Skills assessment/mentoring' is the stand-in for what I would refer to much more broadly as 'talent management,' then the list misses many of the skills needed to get the most from people."

Forecasting the Next New Lawsuit
Law firms use business and competitive intelligence to help them better understand the business environment. But while BI and CI focus on what has been, it is also possible to try forecasting what will be, observes Ron Friedmann at Prism Legal. He cites a recent BusinessWeek article, Is That A Lawsuit Blowing In?, that describes work by Risk Management Solutions and Rand to forecast class action lawsuits using techniques similar to ones used to forecast natural disasters. Friedmann notes:

"Plaintiffs' lawyers are likely to be the first to read the results. BigLaw, which defends both corporations and insurers, should keep up with this research as well."

And given that forecasting involves math and technology, lawyers are sure to get their CFOs and CIOs involved as well, Friedmann adds.

U.K. Firm's 'Crowning' Achievement
Justin Patten at Human Law extends congratulations to One Crown Office Row Chambers, which Internet reviewer Delia Venables recently singled out as one of the three most interesting chambers sites on the Web. Patten notes that the site includes a Human Rights Database of reports and commentaries dating back to 1998. He gives particular credit to associate Rosalind English, who edits and writes much of the Human Rights material. Still to come to the site, Patten suggests: podcasting.

If you haven't checked out Google Video, you need to, urges Rick Georges at Future Lawyer.  Type "law" in the search box, he says, and up come 1,715 videos.

"This is a great way to kill some time, and see what is out there as well. There are full length videos of law seminars and law conferences, how-to videos, all free for the watching and downloading."

And some, notes Georges, "are even interesting."
